MORTGAGEE’S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Bryan Nicholson and Fabiana Nishioka to Mortgage Electronic Registration Systems, Inc., as nominee for Fairway Independent Mortgage Corporation, its successors and assigns, dated December 6, 2021 and recorded with the Norfolk County Registry of Deeds at Book 40134, Page 257 as affected by a Judgment recorded on November 19, 2025 in Said Registry of Deeds at Book 42777, Page 179, subsequently assigned to Nationstar Mortgage LLC by Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Fairway Independent Mortgage Corporation, its successors and assigns by assignment recorded in said Norfolk County Registry of Deeds at Book 42092, Page 94 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 10:00 AM on July 27, 2026 at 524 Coronation Drive, Franklin, MA, all and singular the premises described in said Mortgage, to wit:
PARCEL I
The land in Franklin, Norfolk County, Massachusetts, being shown as Lot 115 on Coronation Drive on plan entitled "Rolling Green Ridge —Section Ill, Davmar, Inc., Developer" dated March 31, 1958, by Sampson & Publicover, recorded with Norfolk County Registry of Deeds, as plan number 1022 of 1958, Plan Book 206 and bounded and described as follows:
EASTERLY by Coronation Drive, one hundred twenty-eight and 27/100 (128.27) feet; SOUTHERLY by land now or formerly of Orri11, one hundred twenty and 45/100 (120.45) feet; NORTHWESTERLY by Lot 116, one hundred sixty-three and 47/100 (163.47) feet;
NORTHERLY by Royal Court, forty-nine and 55/100 (49.55) feet; and
NORTHEASTERLY by a curve with 30-foot radius, forty-seven and 12/100 (47.12) feet. Containing 15,634 square feet, according to said plan.
Said premises are conveyed subject to and with the benefit of easements, restrictions, agreements and reservations of record, if any, insofar as the same may be in force and applicable.
PARCEL II
That parcel of land situate on the southwesterly side of Coronation Drive in the Town of Franklin, County of Norfolk, State of Massachusetts, being shown as Parcel "A" on a plan entitled "Plan of Land in the Town of Franklin, Massachusetts" dated September 17, 2002 drawn by Edward J. O'Brien, P.L.S., Franklin, MA, recorded with the Norfolk Registry of Deeds as Plan No. 671 of 2002 in Book 501, said parcel containing one thousand six hundred and seventy (1,670) square feet according to said plan.
Being the same premises conveyed by deed of Raphael Soeiro de Faria and Jody Soeiro de Faria to Bryan Nicholson and Fabiana Nishioka recorded at the Norfolk County Registry of Deeds in Book 40134, Page 253.
The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of FIFTEEN THOUSAND DOLLARS AND 00 CENTS ($15,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
FinCEN reporting will be required of all successful purchasers, absent a lawful exemption.
