YOU ARE HEREBY SUMMONED and required to serve upon David B. Venino, Attorney for the Plaintiff, whose address is 700 Boston Blvd., Sea Girt, NJ 08750-0024, Tel. No. (732) 449-2153, an Answer to the Complaint filed in a civil action in which Breckenridge Properties, LLC, etc. is the Plaintiff and Mary Lenora Dinse, etc., et al. are the Defendants, now pending in the Superior Court of New Jersey, within 35 days after the date of the publication of this Notice, exclusive of such date. If you fail to do so, judgment by default may be entered against you for the relief demanded in the plaintiff's Complaint. You shall file your answer or motion, a completed Case Information Statement (available from the Clerk of the Superior Court) and proof of service in duplicate with the Clerk of the Superior Court, Hughes Justice Complex, P.O. Box 971, Trenton, NJ 08625, in accordance with the Rules of Civil Practice and Procedure. A $175.00 filing fee payable to "Treasurer, State of New Jersey" must accompany your answer or motion. The answer or motion should identify this suit by the caption and docket number above. You must also send a copy of your answer or motion to the plaintiff's attorney, whose name and address appear above. A telephone call will not protect your rights. You must file and serve a written answer or motion (with the $175.00 filing fee and completed Case Information Statement) if you want the Court to hear your defense. This action has been instituted for the purpose of foreclosing the following: (1) Tax Sale Certificate No. 2014-0231 issued by the Lacey Township Tax Collector to Jeffrey R. Jerman dated January 18, 2014 and recorded in the Ocean County Clerk's Office on January 30, 2014 in Official Record Book 15736 at Page 542; which lists the assessed owner as "Thomas, Bettie L a/k/a Betty L" and affects lands and premises known as Lots 41 and 42 in Block 1193 as shown on the tax duplicate of the Township of Lacey (no street address); and which was assigned to the plaintiff by Assignment of Tax Sale Certificate dated March 19, 2025 and recorded in the Ocean County Clerk's Office on March 21, 2025 in Official Record Book 19960 at Page 1329 etc.; (2) Tax Sale Certificate No. 2013-0395 issued by the Lacey Township Tax Collector to Jeffrey R. Jerman dated January 26, 2013 and recorded in the Ocean County Clerk's Office on February 15, 2013 in Official Record Book 15448 at Page 562; which lists the assessed owner as "Weigh, Loretta" and affects lands and premises known as Lots 21 and 22 in Block 1251 as shown on the tax duplicate of the Township of Lacey (no street address); and which was assigned to the plaintiff by Assignment of Tax Sale Certificate dated July 26, 2025 and recorded in the Ocean County Clerk's Office on August 1, 2025 in Official Record Book 20090 at Page 663 etc.; (3) Tax Sale Certificate No. 2015-0450 issued by the Lacey Township Tax Collector to the plaintiff dated January 17, 2015 and recorded in the Ocean County Clerk's Office on February 17, 2015 in Official Record Book 16007 at Page 932; which lists the assessed owner as "Rochford, Lorraine R" and affects lands and premises known as Lots 20 and 21 in Block 1867 as shown on the tax duplicate of the Township of Lacey (no street address); (4) Tax Sale Certificate No. 2021-0071 issued by the Lacey Township Tax Collector to Todd M. Jerman dated January 14, 2021 and recorded in the Ocean County Clerk's Office on February 10, 2021 in Official Record Book 18310 at Page 43; which lists the assessed owner as "Daniels Robert E Jr & Carol S" and affects lands and premises known as Lots 22 and 23 in Block 1580 as shown on the tax duplicate of the Township of Lacey (no street address); and which was assigned to the plaintiff by Assignment of Tax Sale Certificate dated March 18, 2025 and recorded in the Ocean County Clerk's Office on March 21, 2025 in Official Record Book 19960 at Page 1305 etc.; (5) Tax Sale Certificate No. 2017-0276 issued by the Lacey Township Tax Collector to Todd M. Jerman dated January 13, 2017 and recorded in the Ocean County Clerk's Office on January 31, 2017 in Official Record Book 16646 at Page 1568; which lists the assessed owner as "Fletcher Family Trust c/o Fletcher T" and affects lands and premises known as Lots 24 and 25 in Block 1864 as shown on the tax duplicate of the Township of Lacey (no street address); and which was assigned to the plaintiff by Assignment of Tax Sale Certificate dated May 8, 2026 and recorded in the Ocean County Clerk's Office on June 5, 2026 in Official Record Book 20395 at Page 1742 etc.; (6) Tax Sale Certificate No. 2021-0073 issued by the Lacey Township Tax Collector to Todd M. Jerman dated January 14, 2021 and recorded in the Ocean County Clerk's Office on February 10, 2021 in Official Record Book 18310 at Page 41; which lists the assessed owner as "Nutting, Geo c/o Nutting Margaret D" and affects lands and premises known as Lots 39 and 40 in Block 1858 as shown on the tax duplicate of the Township of Lacey (no street address); and which was assigned to the plaintiff by Assignment of Tax Sale Certificate dated March 10, 2025 and recorded in the Ocean County Clerk's Office on March 21, 2025 in Official Record Book 19960 at Page 1327 etc.; and (7) Tax Sale Certificate No. 2020-0171 issued by the Lacey Township Tax Collector to the plaintiff dated January 16, 2020 and recorded in the Ocean County Clerk's Office on January 27, 2020 in Official Record Book 17766 at Page 254 etc.; which lists the assessed owner as "Schramm, Albert W c/o Schramm R C" and affects lands and premises known as Lots 9 and 10 in Block 1586 as shown on the tax duplicate of the Township of Lacey (no street address). A copy of the plaintiff's Complaint will be provided to you upon request. You and each of you are made defendants in the above titled action because you have, or may claim to have, some right, title, lien or other interest affecting the real estate being foreclosed by virtue of ownership, inheritance, descent, intestacy, devise, legacy, dower, curtesy, mortgage, deed of conveyance, entry of judgment or other legal or lawful right. You are advised of the right to exercise the affirmative defense of surplus equity to this foreclosure action pursuant to Tyler v. Hennepin County, 598 U.S. 631 (2023) and/or New Jersey Statute. Accordingly, the owner or the owner's heirs have the right to demand, in writing to the Superior Court before the date final judgment is entered, that the foreclosure proceed to a judicial sale as in the manner of a foreclosure of a mortgage or (if available) an Internet auction of the premises, through the office of the county sheriff; and, specifically: if the plaintiff's lien is not redeemed, or you do not elect to have this action brought to sheriff's sale, you are at risk of losing your equity in the premises; the potential loss of equity in the premises is a valid basis to contest this action; and you have the right to request a sheriff's sale which would require any surplus beyond the amount due to the plaintiff to be deposited with the Trust Fund of the Superior Court, for which any parties entitled thereto may make application for their appropriate share.
