By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Michael Bond and Paul Thomas to Mortgage Electronic Registration Systems, Inc., as nominee for Mortgage Lenders Network USA, Inc., its successors and assigns, dated September 29, 2005 and recorded with the Worcester County (Worcester District) Registry of Deeds at Book 37448, Page 252, subsequently assigned to U.S. Bank, National Association, as Trustee for RASC 2005-EMX5 by Mortgage Electronic Registration Systems, Inc., as nominee for Mortgage Lenders Network USA, Inc., its successors and assigns by assignment recorded in said Worcester County (Worcester District) Registry of Deeds at Book 47985, Page 154, subsequently assigned to U.S. Bank National Association, as Trustee for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2005-EMX5 by U.S. Bank, National Association, as Trustee for RASC 2005-EMX5 by assignment recorded in said Worcester County (Worcester District) Registry of Deeds at Book 54872, Page 392, subsequently assigned to U.S. Bank Trust Company, National Association, as trustee, as successor-in-interest to U.S. Bank National Association, as Trustee for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2005-EMX5 by U.S. Bank National Association, as Trustee for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2005-EMX5 by assignment recorded in said Worcester County (Worcester District) Registry of Deeds at Book 72922, Page 283 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 11:00 AM on July 29, 2026 at 2178 Main Street, Warren, MA, all and singular the premises described in said Mortgage, to wit:
The land in the Village of West Warren, Town of Warren, Worcester County, Massachusetts, bounded and described as follows:
TRACT 1
A certain tract or parcel of land with the buildings thereon, situate on the northerly side of West Main Street, in said West Warren and being part of Lot No. 13 on plan of W.H. Thompson, C.E., recorded with the Worcester District Registry of Deeds in Plan Book 58, Plan 57 and being more particularly described as follows:
BEGINNING at an iron pin in the ground on the northerly line of West Main Street, said pin being at the southwesterly corner of the tract herein described and at the southeasterly corner of other land now or formerly of Maria Giroux, said pin also being opposite the center of the two family house numbered 51 and 52 West Main Street;
THENCE northeasterly 125.46 feet along other land of said Giroux and passing through the partition wall between tenements numbered 51 and 53 to an iron pin in the ground at land now or formerly of one Methot;
THENCE easterly 37.2 feet along land now or formerly of said Methot to an iron pin in the ground at the northwesterly corner of Lot No. 14 as shown on said plan;
THENCE S. 6° 45' W. 124.98 feet along said Lot No. 14 to the northerly line of Main Street;
THENCE N. 83° 15' W. 38 feet along the northerly line of West Main Street to an iron pin in the ground and the place of beginning.
Said lot, being a portion of Lot No. 13, is conveyed subject to the right of the Town of Warren and others to maintain pipes for the conveyance of sewage through the same and the rights of repair and maintenance incidental thereto, said lot being the easterly portion of lot numbered 13.
Said premises are conveyed subject to the right of the Thorndike Company, its successors and assigns, to maintain water pipes as now laid through said premises for the purpose of conveying water through the same. Together with the right to enter upon said premises for the purpose of maintaining and relaying said pipes.
TRACT 2
A certain tract or parcel of land with the buildings thereon, situate on the northerly side of West Main Street, and being part of Lot No. 13 on plan of W.H. Thompson, C.E., recorded with the Worcester District Registry of Deeds in Plan Book 58, Plan 7 and being bounded and described as follows:
BEGINNING at a stone bound in the ground on the northerly line of West Main Street at the southwesterly corner of the tract herein described and at the southeasterly corner of land now or formerly of said Methot;
THENCE N. 15° 30' E. 125.94 feet along land now or formerly of said Methot to a stone bound;
THENCE easterly 32.4 feet along land of said Methot to an iron pin in the ground;
THENCE southwesterly 125.46 feet passing through the partition wall between tenements numbered 51 and 53 West Main Street to an iron pin in the ground on the northerly line of West Main Street;
THENCE N. 79° W. 43.16 feet along the northerly line of said Main Street to a stone bound and the place of beginning.
Containing 4,725 square feet.
Said lot, being a portion of Lot No. 13, is conveyed subject to the right of the Thorndike Company, its successors and assigns, to maintain water pipes as now laid through said Lot No. 12 and Lot No. 13 for the purpose of conveying water through the same. Together with the right to enter upon said tracts for the purpose of maintaining and relaying said pipes.

The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
FinCEN reporting will be required of all successful purchasers, absent a lawful exemption.
