By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Ronald Vargas a/k/a Ronald J. Vargas and Dorothy Vargas a/k/a Dorothy K. Vargas to Mortgage Electronic Registration Systems, Inc., as nominee for Homecomings Financial Network, Inc., its successors and assigns, dated September 22, 2004 and registered with the Plymouth County Registry District of the Land Court as Document Number 618168 noted on Certificate of Title Number 110160 as affected by an Order registered on February 28, 2013 in Said Registry District of the Land Court as Document Number 704798 noted on Certificate of Title Number 114679 and 110160 as affected by an Order registered on February 28, 2013 in Said Registry District of the Land Court as Document Number 704799 noted on Certificate of Title Number 110160, subsequently assigned to GMAC MORTGAGE, LLC by MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. by assignment registered with Plymouth County Registry District of the Land Court as Document Number 653625 noted on Certificate of Title Number 110160, subsequently assigned to Select Portfolio Servicing, Inc. by GMAC Mortgage, LLC by assignment registered with Plymouth County Registry District of the Land Court as Document Number 850022 noted on Certificate of Title Number 110160, subsequently assigned to U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR RCAF ACQUISITION TRUST by Select Portfolio Servicing, Inc. by assignment registered with Plymouth County Registry District of the Land Court as Document Number 862913 noted on Certificate of Title Number 110160 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 11:00 AM on July 29, 2026 at 3 Pine Tree Drive, a/k/a 3 Pinetree Drive, Middleboro, MA, all and singular the premises described in said Mortgage, to wit:
The land with the buildings thereon, situated in Middleboro, Plymouth County, Massachusetts, further bound and described:
NORTHERLY by Pine Tree Drive one hundred sixteen and 35/100 (116.35) feet;
SOUTHEASTERLY by Lot 7, as shown on a plan hereinafter mentioned, one hundred sixty-three and 91/100 (163.91,) feet ,and
WESTERLY by Lot 3, Lot y and Lot 5, as shown on said plan one hundred eighty (180.00) feet.
Said Lot is being shown as Lot 6 on Sheet 1. Alt of said boundaries are determined by the Court to be located as shown on plan No. 29482B, drawn by Perkins Engineering; Inc., Surveyors, dated January 24, 1972, as modified and approved by the Court, filed in the Land Registration Office, a copy of a portion of which is filed with Certificate of Title No. 33800.
Said premises are conveyed subject to and with the benefit of the right to use Pine Tree Drive for all purposes for which streets and ways are used in the Town of Middleborough in common with all others entitled thereto. Said premises are also conveyed subject to restrictive covenants dated January 17, 1972, and registered as Document No. 141083.
The grantor reserves to itself, its successors and assigns the right to build and maintain said streets and ways and also the right to install and maintain any and all public utilities therein, together with the right to grant to others similar rights.

The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of TEN THOUSAND DOLLARS AND 00 CENTS ($10,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
