MORTGAGEE’S SALE OF REAL ESTATE
By virtue and in execution of the power of sale contained in a certain Mortgage, Assignment of Leases and Rents, Security Agreement and Fixture Filing from Timothy J. Fullum to JGB Collateral LLC dated August 2, 2023, and recorded with the Worcester District Registry of Deeds in Book 69497, Page 127, as amended by that certain Amendment to Mortgage, Assignment of Leases and Rents, Security Agreement and Fixture Filing dated April 20, 2026 and recorded with the Worcester District Registry of Deeds in Book 73574, Page 62, for property located at and known as 105 Adin Street, Hopedale, Worcester County, Massachusetts (the “Mortgage”), of which Mortgage the undersigned is the present holder (the “Lender”), for breach of the conditions of the Mortgage and for the purpose of foreclosing the same, will be sold at public auction at 11:00 A.M. on Thursday, July 30, 2026, on the premises located at 105 Adin Street, Hopedale, Worcester County, Massachusetts, described in the Mortgage (the “Mortgaged Premises”) as follows:
“The land in Hopedale, Worcester County, Massachusetts, with buildings thereon, shown as Lot 1 on a plan entitled "Plan of Land in Hopedale, Mass., Property of Estate of Nicholas A. Mastroianni, Scale: 40 feet to an inch, Date: April 23, 1975, Guerriere and Halnon, Inc., Engineering and Land Surveying, 326 West Street, Milford, Mass.," recorded with the Worcester District Registry of Deeds in Plan Book 422, Plan 91, and being more particularly bounded and described according to said plan as follows:
NORYTHERLY by Adin Street, 73.54 feet;
NORTHEASTERLY by land of the Town of Hopedale, 287.61 feet;
SOUTHEASTERLY by Mendon Street (Route 16), 369.35 feet
SOUTHERLY by Lot 3 on said plan, 262.02 feet;
NORTHWESTERLY by Lot 2 on said plan, 282.87 feet;
WESTERLY by said Lot 2, 141.29 feet.
Containing according to said plan 2.36 acres.”
Said sale shall be subject to:
1. All outstanding real estate taxes, tax titles, tax liens, electricity, sewer and water charges, improvements, betterment assessments and other municipal liens and any pending proceedings for the enforcement of such liens;
2. Any outstanding orders of the Department of Health, or any other municipal, state or Federal agency;
3. Any existing tenants or other parties in possession;
4. Rights, rights of way, easements, restrictions, covenants, tax takings, liens or claims in the nature of liens, attachments and mortgages of record having priority over the foreclosed mortgage;
5. Twelve foot wide driveway easement granted to Mary K. Mastroianni dated June 28, 1978 and recorded in Book 6495, Page 179 and shown on Plan Book 470, Plan 75;
6. Easement for “Overhead System” to Massachusetts Electric Company and Verizon New England, Inc. dated July 15, 2019 and recorded in Book 60880, Page 104; and
7. Possible encroachment of Lower Garden and Balustrade as shown on Plan Book 422, Plan 91.
Terms of sale: A deposit of Twenty-Five Thousand and 00/100 Dollars ($25,000.00) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. An additional deposit in the amount required to bring the total deposit to five percent (5%) of the purchase price by wire transfer at Mirick, O’Connell, DeMallie & Lougee, LLP, 100 Front Street, Worcester, Massachusetts 01608, will be required to be paid by the purchaser on the fifth (5th) business day after the sale date. The balance of the purchase price is to be paid by wire transfer at Mirick, O’Connell, DeMallie & Lougee, LLP, 100 Front Street, Worcester, Massachusetts 01608 within forty-five (45) days from the date of the sale (the “Closing Date”). The Lender may extend the Closing Date in the Lender’s sole and absolute discretion upon the request of purchaser. A Deed will be provided to the purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said Mortgage shall control. The Lender shall not be required to pay a deposit if the Lender is the high bidder.

The Lender reserves the right to continue the sale from time to time by public announcement at the time and date of the original or any continued sale.
If the highest bidder fails to complete the purchase of the Mortgaged Premises on the terms provided in this notice and in the Memorandum of Sale signed following the auction, the Lender reserves the right to convey the Mortgaged Premises to the second highest bidder at the auction. If the Lender exercises that right it will notify the second highest bidder who will then have three (3) days to deliver the deposit specified above to the Lender’s attorney, Mirick, O’Connell, DeMallie & Lougee, LLP, and to agree upon a date for delivery of the deed.
