NOTICE TO ABSENT DEFENDANTS

You are hereby summoned and required to serve upon Robert A. Del Vecchio, Esq, Plaintiff's attorney, whose address is P O Box 561, Hawthorne, New Jersey 07507, an answer to the complaint, and any amendments, if any, (collectively, the "Complaint") filed in a civil action in which MGRP TL Capital, LLC is the Plaintiff and Philip William Speulda, et al. are defendants, pending in the Superior Court of New Jersey, within 35 days after July 13, 2026 exclusive of such date. If you fail to do so, judgment by default may be rendered against you for the relief demanded in the Complaint. You shall file your answer and proof of service in duplicate with the Clerk of the Superior Court, Hughes Justice Complex, Trenton, New Jersey, in accordance with the rules of Civil Practice and Procedure. You are further advised that if you are unable to obtain an attorney, you may communicate with the Passaic County Lawyer Referral Service and that if you cannot afford an attorney, you may communicate with the Legal Services office of the County of Passaic. The action has been instituted for the purpose of foreclosing upon a Tax Sale Certificate No. 22-00005 dated December 6, 2023, and recorded in the Passaic County Clerk's Office on December 22, 2023, in Mortgage Book M18742, Page 288, et seq. and covers real estate located in the Borough of Hawthorne, County of Passaic and State of New Jersey known as Block 118, Lot 10 as shown on the Official Tax Map of the Borough of Hawthorne, New Jersey and commonly known as 363 Diamond Bridge Avenue, Hawthorne, New Jersey.
You and each of you are made defendants in the above entitled action because you have or may claim to have some right, title, lien or other interest affecting the real estate being foreclosed, by virtue of ownership, inheritance, descent, intestacy, devise, dower, curtsey, mortgage, deed or conveyance, entry of judgment or other legal or lawful right. The nature of which and reason that you and each of you are joined as defendants is set forth with particularity in the complaint, a copy of which will be furnished you on request addressed to the attorneys of plaintiff at the above mentioned address.
Tax Foreclosure Notice: This action is a "Strict Foreclosure" and as a result there is no Sheriff Sale procedure if Final Judgment is entered in its normal course. As a consequence, if Final Judgment is ultimately entered then title to the Property shall vest in the Plaintiff. Defendants with a right of redemption of plaintiff's lien are hereby notified of the following: (a) if plaintiff's lien is not redeemed, or you do not elect to have this action brought to sheriff's sale, you are at risk to lose your equity in the Property; (b) the potential loss of equity in the Property is a valid basis to contest this matter; and (c) You have the right to request a sheriff's sale which would then require any surplus beyond the amount owed to plaintiff to be deposited with the Superior Court Trust Fund. You must be guided accordingly. In addition to those rights, you hereby provided notice that you can request to either Plaintiff's Attorney Robert A. Del Vecchio, Esq., 405 Lafayette Avenue, Hawthorne, New Jersey 07506 or to the above Court, that you want this matter to be sent to Sheriff Sale if it is your position that upon the proofs there will be surplus equity remaining in the subject Property, per Tyler v. Hennepin County, 598 U.S. 631 (2026), which you might withdraw at a subsequent time upon application to the Court and to the Sheriff. If there is no such surplus equity, or if you do not timely request such Sheriff Sale, then the Foreclosure will continue as a Strict Foreclosure and, as per above, upon entry of Final Judgment Title to the Property shall vest in the Plaintiff.
