By virtue and in execution of the Power of Sale contained in a certain mortgage given by Joaquim Monte and Rebecca C. Monte f/k/a Rebecca C. Raymond to St. Anne's Credit Union of Fall River, Mass., dated December 9, 2010, and recorded with the Bristol County (Fall River District) Registry of Deeds in Book 7586, Page 309, of which mortgage the undersigned is the present holder by an assignment of mortgage from St. Anne's Credit Union of Fall River, Mass. to Federal National Mortgage Association, dated December 17, 2010, and recorded with said Deeds in Book 10435, Page 89; by an assignment of mortgage from Federal National Mortgage Association to St. Anne's Credit Union f/k/a St. Anne's Credit Union of Fall River, Mass., dated April 16, 2026, and recorded with said Deeds in Book 12036, Page 64. For breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 1:00 P.M. on the 13th day of August 2026, at 1084 Meridian Street, Fall River, MA 02720, all and singular the premises described in said mortgage,

The land in Fall River, in Bristol County and Commonwealth of Massachusetts, with all buildings and improvements thereon, bounded and described as follows:
Beginning at a point at the southeast corner of the parcel to be described on the westerly side of Meridian Street and at the northeast corner of land of Donald G. And Helen L. Loos; thence running westerly by land of said Loos, Nine Hundred Three and 62/100 (903.62) feet, more or less, to the easterly layout line of the Amvets Memorial Highway, Route 24; thence northerly by said Amvets Memorial Highway, Route 24, Sixty-six feet, more or less, to other land of now or formerly of John M. Medeiros and Maria Medeiros, and Parcel 2 on the plan hereinafter referred to; thence running easterly by said Parcel 2, Seven Hundred Forty-five (745) feet, more or less, to an angle point; thence deflecting to the northeast and continuing by Parcel 2, One Hundred Forty-eight (148) feet, more or less, to the westerly line of Meridian Street; thence southerly by the westerly line of Meridian Street, Eighty (80) feet, more or less, to the point of beginning; containing 60,350 square feet of land, more or less, and however otherwise bounded and described, being Parcel #1 on Plan of Land of Thomas R. And Mary Sears, dated March 1974, Scale 1 inch = 80 feet, drawn by Paul J. Lyons, Registered Land Surveyor, which Plan is recorded in the Fall River District Registry of Deeds.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of ten thousand dollars ($10,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by wire transfer to Demerle & Associates P.C., 10 City Square, 4th Floor, Boston, MA 02129 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
