RESOLUTION [To Set a Public Hearing to Declare the Abundance of Overgrown Grass and Weeds at 1115 Mary Drive to be Unsafe and a Public Nuisance and Order Its Abatement Pursuant to Chapter 46 et seq., City of Prattville Code of Ordinances.] WHEREAS, an abundance of overgrown grass and weeds: 1. is injurious to the public health, safety and general welfare of the community by providing a breeding ground and shelter for rats, mice, snakes, mosquitoes, and other vermin; 2. may cause the further spread of weeds; 3. may hide debris, such as glass or metal, that could inflict injury on a person going to such property; 4. may also pose a fire hazard and respiratory hazard; and WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected the property and determined the existence of an abundance of overgrown grass and weeds at 1115 Mary Drive; and WHEREAS, the Autauga County tax records list the property owner(s) as KC Homes and Investments LLC c/o Velocity Commercial Capital LLC & US Bank Trust Co Trustee, with a mailing address of 2945 Townsgate Road, Ste 110, Westgate Village, CA 91361, to Parcel Number 19 02 10 4 010 035.000; and WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the Code Enforcement Officer gave written notice to the owner(s) of said property on June 10, 2026, to correct, remedy, or remove the abundance of grass and weeds within ten (10) days; and WHEREAS, the owner(s) of said property have failed and/or refused to correct, remedy, or remove said condition by the expiration of said notice; and WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City Council to declare the abundance of overgrown grass and weeds to be a public nuisance and abate the same; and WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances, declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering their abatement by the City Council initiates a fine for the first violation and designation on the repeat offender registry. NOW, THEREFORE, BE IT RESOLVED THAT: 1. the City Council of the City of Prattville declares the abundance of overgrown grass and weeds at said property to be a public nuisance and has therefore initiated the abatement process; and 2. the owner(s) of said property are ordered to abate said nuisance and appear before the City Council at a Public Hearing at 6:00 p.m. on August 4, 2026, at Prattville City Hall; and 3. any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the Public Hearing; and 4. the fine of $100.00 shall be assessed to the owner(s) of said property in addition to any costs incurred for the abatement process; and 5. said property shall be placed on the repeat offender registry for a period of three (3) years; and 6. the notice of Public Hearing on the matter, as required by law, will be provided in a publication of general circulation, by certified mail, and by signage on the subject property.
