ORDINANCE NO. 18-26
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF BUCKEYE, ARIZONA, APPROVING A MAJOR AMENDMENT TO THE WESTPARK COMMUNITY MASTER PLAN ("CMP") AS DESCRIBED IN CASE NUMBER PLZZ-25-0010 RELATED TO APPROXIMATELY 1,948.2 ACRES WITHIN AND ADJACENT TO THE CMP; EXPANDING THE CMP BOUNDARY THROUGH INCORPORATION OF LAND CURRENTLY WITHIN THE WESTWIND AND SILVER ROCK COMMUNITY MASTER PLANS AND ADDITIONAL ADJACENT ACREAGE NOT CURRENTLY WITHIN A CMP; MODIFYING THE CMP LAND USE PLAN TO EXPAND OPPORTUNITIES FOR COMMERCIAL, BUSINESS PARK, AND LIGHT INDUSTRIAL DEVELOPMENT IN THE AMENDMENT AREA; AND PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES AND SEVERABILITY.
WHEREAS, the proposed amendment to the Westpark CMP, Case No. PLZZ-25-0010, applies to approximately 1,948.2 acres of land legally described and depicted on Exhibit A ("2026 Amendment Area"); and
WHEREAS, a portion of the 2026 Amendment Area includes land previously included in the Westwind CMP, approved by the City on February 1, 2004, by and through Ordinance No. 15-05, which land area will be removed from the Westwind CMP and incorporated into the Westpark CMP; and
WHEREAS, a portion of the 2026 Amendment Area includes land previously included in the Silver Rock CMP, approved by the City on February 15, 2005, by and through Ordinance No. 13-05, which land area will be removed from the Westwind CMP and incorporated into the Westpark CMP. The Silver Rock CMP will continue in full force and effect on the remaining land area; and
WHEREAS, the proposed amendment to the Westpark CMP, Case No. PLZZ-25-0010, was properly noticed for public hearings, and the necessary hearings were conducted on June 23, 2026 and July 7, 2026; and
WHEREAS, the proposed amendment will enhance the welfare of the community by creating a unified planning framework and contributing to the City's economic well-being, and is in harmony with the purposes and intent of the City Development Code and the General Plan; and
WHEREAS, in accordance with Article II, Sections 1 and 2 of the Constitution of Arizona, the Council has considered the individual property rights and personal liberties of the residents of the City before adopting this Ordinance; and
WHEREAS, the City of Buckeye Planning & Zoning Commission held a public hearing on June 23, 2026, and recommended approval of this zoning change subject to conditions.
BE IT ORDAINED, by the Mayor and Council of the City of Buckeye, Arizona, as follows:
Section 1. The recitals set forth above are incorporated as if fully set forth herein.
Section 2. The Amendment to the Westpark CMP set forth in Case No. PLZZ-25-0010 is hereby approved, subject to the conditions of approval attached hereto as Exhibit B, attached hereto and incorporated herein by this express reference.
Section 3. Unless portions are superceded by and through this Ordinance No. 18-26, or future legal action or applicable law, the Pre-Annexation and Development Agreement recorded on October 24, 2000 in the Official Records of the Maricopa County Recorder at Document No. 2000-0815885, as amended by the First Amendment to Pre-Annexation and Development Agreement dated September 18, 2001 and recorded on January 25, 2002 in the Official Records of the Maricopa County Recorder at Document No. 2002-0080479, and the Development Agreement dated December 6, 2022 and recorded on December 16, 2022 in the Official Records of the Maricopa County Recorder at Document No. 2022-0895675 and related conditions of approval remain in full force and effect until subsequently amended or terminated.
Section 4. The Westwind Development Agreement dated March 11, 2005 and recorded in the Official Records of the Maricopa County Recorder on March 21, 2005 as Instrument No. 2005-0339471 by and between the City and Westwind Properties, L.L.C. has automatically expired by its express terms.
Section 5. The Westwind CMP is hereby terminated as to the land area included in the Westpark CMP, and is no longer subject to the rights, duties or obligations of the Westwind CMP.
Section 6. All ordinances and parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed.
Section 7. If any section, subsection, or clause of this Ordinance shall be deemed to be unconstitutional or otherwise invalid, the validity of the remaining sections, subsections, and clauses shall not be affected.
Section 8. The Mayor, City Manager, City Attorney, and City Clerk are hereby authorized and directed to take all steps and execute all documents necessary to carry out the purpose and intent of this Ordinance.
