NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
Premises: 3 B Street, Pembroke, MA 02359
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Charles S Yannizzi to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for South Coastal Bank, and now held by U.S. Bank Trust National Association, not in its individual capacity but solely as Owner Trustee for RCAF Acquisition Trust, said mortgage dated February 16, 2011 and recorded in the Plymouth County Registry of Deeds in Book 39678, Page 219, said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for South Coastal Bank to Truist Bank by assignment dated August 2, 2022 and recorded with said Registry of Deeds in Book 57096, Page 160; said mortgage was assigned from Truist Bank to Specialized Loan Servicing LLC by assignment dated February 16, 2024 and recorded with said Registry of Deeds in Book 58677, Page 35; said mortgage was assigned from NewRez LLC FKA Specialized Loan Servicing LLC to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCAF Acquisition Trust by assignment dated August 4, 2025 and recorded with said Registry of Deeds in Book 60229, Page 86; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on August 6, 2026 at 09:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
PARCEL I
The land with the buildings thereon situated on "B" Street in Pembroke, Plymouth County, Massachusetts, and being shown as Lots Numbered 721, 722, 723 and 724 on a plan entitled, "Plan A Silver Lake Land Company Pembroke and Halifax, Mass .," dated April 1889, being Frame 2 of 2 Frames dated April 1889, J.C. Torrey, Civil Engineer, recorded with Plymouth Deeds, Plan Book 1, Page 59 to which said plan reference is hereby made for a more particular description.
PARCEL II
Certain lots of land situated in the said Pembroke, being Lots Numbered Seven Hundred Nineteen (719) and Seven Hundred Twenty (720), as shown on Plan A of "Silver Lake Land Company, Pembroke and Halifax, Mass. Scale 1 in. = 80 Ft. Apr. 1883, J.C. Torrey C.E. Whitman, Mass." recorded with Plymouth County Registry of Deeds, Plan Book 1, Page 59, the same also being known as Lots 719 and 720 on the Town of Pembroke Assessors Plan 82.
Being the same premises conveyed to the herein named mortgagor by deeds recorded with Plymouth County Registry of Deeds in Book 3915, Page 545 and in Book 7256, Page 332.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated July 26, 1973 and recorded in the Plymouth County Registry of Deeds in Book 3915, Page 545 and deed dated November 6, 1989 and recorded in said Registry in Book 7256, Page 332.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
