DISCOVERY AT CONTINENTAL ORCHARD HOMEOWNERS' ASSOCIATION AKA DISCOVERY AT SUNRISE, an Arizona non-profit corporation, Plaintiff(s),
vs.
DANIEL GONZALEZ, SR. a single man; ROOT INSURANCE COMPANY, an Ohio corporation, Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 5th day of May, 2026, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 11th day of June, 2025, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendant, above-named, as follows:
The principal amount of $9,031.44 plus accruing assessments of $258.00 monthly or such greater amount as Discovery may assess in the future as a Common Expense Lien on the Property, together with interest thereon at the rate of 12% per annum from the date the judgment unit paid in full; For Discovery at Continental Orchard Homeowners’ Association aka Discovery at Sunrise’s reasonable attorneys’ fees in the amount of $2,472.50 and court costs in the amount of $908.31, together with interest thereon at the rate of 8.5% per annum from the date of judgment until paid in full against Defendant Daniel Gonzalez Sr; For pre-judgment interest on the principal amount at the rate of 12% in the amount of $1,083.77; For Discovery at Continental Orchard Homeowners’ Association aka Discovery at Sunrise’s reasonable attorneys’ fees, costs and expenses incurred in executing upon the Judgment including, but not limited to, all attorneys’ fees, costs and expenses incurred in scheduling and conducting the sale and, if necessary, obtaining possession of the Real Property, recording any subsequent deed, and costs to repair and sell the Real Property, upon application to the Court, in satisfaction of all amounts due to the Association, presently in the amount of $20,421.27. This amount was reached by adding the Judgment, which totals $13,496.02, post-judgment interest in the amount of $1,056.63, post-judgment assessments of $2,838.00, and attorneys’ fees and costs in the amount of $3,030.62, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendant, on the following described real property, to-wit:
Unit 1177, of DISCOVERY AT CONTINENTAL ORCHARD, according to the Declaration of Horizontal Property Regime recorded October 3, 1985 in Document No. 85-471293 of Official Records, per map recorded in Book 286 of Maps, Page 13, and Affidavit of Correction recorded October 10, 1986 in Document No. 86-556749, in the office of the County Recorder of Maricopa County, Arizona.
TOGETHER WITH a proportionate interest in and to the Common Areas, as set forth in said Declaration of Horizontal Property Regime and shown on said plat.
AKA: 921 West University Dr Unit 1177, Mesa, Arizona 85201.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 30th day of July, 2026, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
