Ana Maria E. Cruz of Brockton, in the County of Plymouth, and to all other persons interested.
A petition has been presented to said Court by Victor E. Cruz of San Diego, CA, representing that he holds as tenant in common an undivided part or share of certain land lying in Brockton, in said county of Plymouth and briefly described as follows:
Street Address: 55 Foster Street, Brockton, MA 02301
The land in said Brockton, Plymouth County, Massachusetts, with all buildings and improvements thereon, situated on the northerly side of Foster Street, bounded and described as follows:
Beginning on said street, at the southeasterly corner of the described premises, being the southwesterly corner of land now or formerly of one Moran; thence,
NORTHEASTERLY — land now or formerly of said Moran, one hundred and 50/100 (100.50) feet to a corner; thence,
WESTERLY — by land now or formerly of Thomas Lyons, sixty and 50/100 (60.50) feet to a corner; thence,
SOUTHERLY — by land now or formerly of Hugh Kelliher, one hundred and 50/100 (100.50) feet to said Foster Street; and thence.
EASTERLY — by said Foster Street, fifty-four and 25/100 (54.25) feet to the point of beginning.
setting forth that he desires that all of said land may be sold at private sale for not less than $550,000.00 dollars and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided either at private sale or public auction, and be ordered to distribute the net proceeds thereof.
If you desire to object thereto you or your attorney should file a written appearance in said Court at Plymouth before ten o’clock in the forenoon on the twenty – second day of July, 2026, the return day of this citation.
