OWNER - The Village of Morton acting through its Village Board, hereby gives notice that bids will be received in the Village Hall for the following described project.
PROJECT - The work shall consist of modifications to a Wastewater Treatment Facility. This project is expected to be funded in part by a loan from the Illinois Environmental Protection Agency (IEPA).

MODIFICATIONS CONTRACT A - PLANT 2
TIME - Sealed Bids will be received until 10:00 a.m., local time (CST), on August 11, 2026, via QuestCDN eBidDocTM at which time and place all Bids will be publicly opened and read aloud.
BIDS - All Bids shall be submitted via QuestCDN eBidDocTM. All Bidders shall Bid in accord¬ance with and upon the Bid Forms included in the Contract Documents.
EXAMINATION OF BID DOCUMENTS - The Bid Documents are on file for inspection at the offices of McMahon Associates, Inc., 1700 Hutchins Road, Machesney Park, IL 61115.
PROCUREMENT OF BIDDING DOCUMENTS - In order to be a ‘Plan Holder’ or ‘Bidder,’ each firm or organization shall download Bidding Documents from the McMahon Associates, Inc. website (www.mcmgrp.com) utilizing QuestCDN eBidDocTM.

BID SECURITY - No Bid shall be received unless accompanied by a Certified Check or satisfactory Bid Bond payable to the Village of Morton in an amount not less than ten percent 5% of the maximum Bid as a guarantee that, if the Bid is accepted, the Bidder will execute and file the Contract, Performance/Payment Bonds and Insurance Certification, as required by the Contract Documents, within ten (10) days after the Notice of Award.
BID REJECTION - The OWNER reserves the right to reject any and all Bids, waive any informalities in Bidding or to accept the Bid or Bids which best serves the interests of the Village of Morton.
WITHDRAWAL OF BIDS - No Bid shall be withdrawn for a period of 90-days after the scheduled opening without the consent of the OWNER.
PRE-BID MEETING - A Pre Bid Meeting and project walk-through will be held July 28, 2026, at 9:30 a.m., local time, at the Plant 2 Wastewater Plant. All Prime Bidders are required to attend; attendance by subcontractors is optional.
STATE OF ILLINOIS GOVERNING LAWS AND REGULATIONS
Contract Letting
1. The Contract letting shall be subject to Illinois Statutes.
2. Any Contract or Contracts awarded under this Advertisement for Bids are expected to be funded in part by a loan from the Illinois Environmental Protection Agency (Illinois EPA). Neither the State of Illinois nor any of its departments, agencies, or employees is or will be a party to this Advertisement for Bids or any resulting Contract. The procurement will be subject to regulations contained in the Procedures for Issuing Loans from the Water Pollution Control Loan Program (35 IAC Part 365), the Davis-Bacon Act (40 USC 276a through 276a-5) as defined by the United States Department of Labor, the Employment of Illinois Workers on Public Works Act (30 ILCS 570), Illinois Works Jobs Program Act (30 ILCS 559/20-1), and the federal “Build America, Buy America Act” requirements contained in the Infrastructure Investment and Jobs Act, Pub. L. No. 117-58.
3. This procurement is also subject to the loan recipient’s policy regarding the increased use of disadvantaged business enterprises. The loan recipient’s policy requires all Bidders to undertake specified affirmative efforts at least sixteen (16) days prior to Bid opening. The policy is contained in the specifications. Bidders are also required to comply with the President’s Executive Order No. 11246, as amended. The requirements for Bidders and CONTRACTORS under this order are explained in 41 CFR 60-4.
Equal Employment Opportunity
1. CONTRACTOR shall comply with the Equal Employment opportunity requirements in the Contract Documents and certify that the CONTRACTOR is not barred from contracting with a local unit of government as a result of a violation of either Section 33E-3 or 33E-4 of the Illinois Criminal Code.
2. The CONTRACTOR and Subcontractors must comply with the Illinois Human Rights Act, the Rules and Regulations of the Illinois Department of Human Rights, and Orders of the Illinois Human Rights Commission, provisions of the Public Works Employment Discrimination Act, 775 Illinois Compiled Statutes, 10/0.01, and the requirements of the Illinois Equal Employment Opportunity clause.
Minimum Wage
1. The CONTRACTOR shall be required to pay not less than the minimum wage rates established by the OWNER, as stated in the Advertisement For Bids.
2. References to applicable wage rates are on file with the OWNER and/or incorporated in the Contract Documents. The CONTRACTOR and all Subcontractors shall be required to pay wages, as applicable, in accordance with the Davis Bacon Act (40 U.S.C. 276a – 276a-7). A link for obtaining current Davis Bacon Wage Rates is included in the Bid Documents.
3. The CONTRACTOR shall pay prevailing wages in accordance with, “An act regulating wages of laborers, mechanics and other workers employed in any public works by the state county city or any public body or any political subdivision or by anyone under Contract for public works” (820 ILCS 130 et seq.). The minimum hourly rate of wages, as determined by the Wage Determination Decision of the Department of Labor or the above-referenced Davis-Bacon wage rates, whichever is higher and referred to in these standards is included in the Bid Documents.
