By virtue and in execution of the Power of Sale contained in a certain Mortgage, given by Rochelle Yvonne Wilkins and Christopher Knight Dik (the "Mortgagor"), to Central One Federal Credit Union, a lending institution, with a usual place of business at 714 Main Street, Shrewsbury, MA 01545 (the "Mortgagee"), dated July 24, 2020, and recorded at Worcester District Registry of Deeds in Book 62872, Page 377, (the "Mortgage"), of which Mortgage the undersigned is the present holder, for breach of the conditions of the Mortgage and for purposes of foreclosing the same will be sold at Public Auction at 10 o'clock AM on August 11, 2026 on the premises located at 8 Oak Circle, Princeton, Massachusetts, which are all and singular the premises described in the Mortgage,
TO WIT: Borrower(s): Rochelle Yvonne Wilkins and Christopher Knight Dik Property Address: 8 Oak Circle, Princeton, MA 01541 Parcel I The land in Princeton, Worcester County, Massachusetts, with any buildings thereon, on the southeasterly side of Oak Circle, being Lot 34 as shown on plan entitled "Wildwood Acres", owned by Donald R. Mathieu, et ux, dated October 5, 1976, drawn by Rene Brothers, Inc. and recorded with the Worcester District Registry of Deeds in Plan Book 437, Plan 99, bounded and described as follows: BEGINNING at a point at the northwesterly corner of lot 34 on the southeasterly side of Oak Circle as shown on said plan; THENCE N. 47° 23' 15" E. along Oak Circle, Two Hundred Twenty-five and 00/100 (225.00) feet to a point; THENCE S. 42° 36' 45" E. by Lot 35 as shown on said plan, Four Hundred Seventy-five and 00/100 (475.00) feet to a point; THENCE S. 47° 23' 15" W. by land now or formerly of Sandstrom, Two Hundred Twenty-five and 00/100 (225.00) feet to a point; THENCE N. 42° 36' 45" W. by Lot 33 as shown on said plan, Four Hundred Seventy-five and 00/100 feet to the point of beginning. Containing 2.454 acres of land according to said plan. Parcel II The land together with any buildings thereon, in Princeton, Worcester County, on the eastern side of Worcester Road (Route 31) containing 1 acre and shown as Lot C2.5 on a plan entitled "Plan of Land in Princeton, Massachusetts (Worcester County)", prepared by BSC Group, Inc., prepared for Princeton Land Trust, dated April 17, 2006, revised June 7, 2006 and recorded with the Worcester District Registry of Deeds in Plan Book 843, Plan 124. Being the same premises conveyed to the mortgagors by deed dated 6/25/2020 and recorded at the Worcester District Registry of Deeds herewith. The description of the premises contained in said Mortgage shall control in the event of a typographical error in this publication. The premises being offered for sale will be sold subject to any and all restrictions, easements, covenants, conditions, agreements, outstanding tax titles, unpaid real estate taxes, and other municipal and public charges, assessments, liens or claims in the nature of liens, rights of others in adjacent streets and ways, and existing encumbrances of record created prior to the mortgage, if any there be, and also subject to all federal, state and municipal laws, regulations, codes and ordinances.
TERMS OF THE SALE: A deposit of Five Thousand Dollars ($5,000.00) by bank or certified check, will be required to be paid by the highest bidder at the time and place of the sale and said bidder will be required to sign a Memorandum of Sale containing the above and any announced terms. The sale will not be complete until such deposit is paid and such Memorandum is signed. In the event the successful bidder at the public auction fails to perform in the time specified to purchase the premises, the Mortgagee reserves the right, at its sole election, to sell the premises by foreclosure deed to the other qualified bidders, in descending order beginning with the next highest bidder and reserves the right, at its sole election, to assume the bid of any defaulting or declining bidder. The Purchaser will be required to deliver the balance of the bid price by bank or certified check within thirty (30) days of the date of the auction sale, at the law firm of Gelinas Petersen Meyers Ryan & Court LLP, 106 Merriam Avenue, Leominster, MA 01453 at which time the foreclosure deed and all related documents will be delivered to the Purchaser. The Purchaser will be solely responsible for filing and recording foreclosure documents and for the payment of deed excise stamps and filing and recording fees. The Purchaser will be responsible for FinCEN reporting, unless there is an applicable exemption, and for any applicable Massachusetts Department of Revenue filing and withholding.
