MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Marcia Vieira to Ameriquest Mortgage Company, dated January 19, 2004 and recorded in Bristol County (Southern District) Registry of Deeds in Book 6768, Page 316 (the “Mortgage”) of which mortgage Deutsche Bank National Trust Company, as Trustee of Ameriquest Mortgage Securities Inc., Asset-Backed Pass-Through Certificates, Series 2004-R2 under the Pooling & Servicing Agreement dated as of March 1, 2004 is the present holder by Assignment from Ameriquest Mortgage Company to Deutsche Bank National Trust Company, as Trustee of Ameriquest Securities Inc., Asset Backed Pass-Through Certificates, Series 2004-R2 Under the Pooling & Servicing Agreement dated as of March 1, 2004 dated November 5, 2007 and recorded at said Registry of Deeds in Book 8947, Page 24, and Confirmatory Assignment from Ameriquest Mortgage Company to Deutsche Bank National Trust Company, as Trustee of Ameriquest Mortgage Securities Inc., Asset Backed Pass-Through Certificates, Series 2004-R2 under the Pooling & Servicing Agreement dated as of March 1, 2004 dated December 15, 2008 and recorded at said Registry of Deeds in Book 9230, Page 72, and Assignment from Ameriquest Mortgage Company to Deutsche Bank National Trust Company, as Trustee of Ameriquest Mortgage Securities Inc., Asset Backed Pass-Through Certificates, Series 2004-R2 dated November 28, 2012 and recorded at said Registry of Deeds in Book 10652, Page 195, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 16 Woodcock Road, North Dartmouth (Dartmouth), MA 02747 will be sold at a Public Auction at 10:00 AM on August 6, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
A certain parcel of land with the buildings and improvements thereon, in North Dartmouth, Bristol County, Massachusetts, being shown as:
Beginning at the southeast corner of the land herein described at a point in the northerly line of Woodcock Road;
Thence N. 73° 00' 43" W., in line of said Woodcock Road, sixteen and 62/100 (16.62) feet to a stake;
Thence N. 54° 17' 34" W., still in line of said Woodcock Road, eighty-three and 38/100 (83.38) feet to a lot #3 as shown on plan of land hereinafter mentioned;
Thence N. 14° 31' 35" E, in line of last named lot, five hundred seventy seven and 66/100 (577.66) feet to land of parties unknown; and
Thence S. 63° 41' 28" E., in line of last named land, one hundred twenty two (122) feet to land of parties unknown; and
Thence S. 16° 59' 17" W., in line of last named land, five hundred eighty four and 11/100 (584.11) feet to the said line of Woodcock Road and the point of beginning.
Containing one and 48/100 (1.48) acres, more or less.
For mortgagor's title see deed recorded with Bristol County (Southern District) Registry of Deeds in book 6768, Page 315.
The property will be sold subject to the redemption rights in favor of the Internal Revenue Service by virtue of the tax lien(s) recorded in Bristol County (Southern District) Registry of Deeds in Book 13899, Page 294, and Book 13908, Page 65.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
