NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
Premises: 230 Summer Street, Plymouth, Massachusetts
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Calderia LLC to Mortgage Electronic Registration Systems, Inc. ("MERS"), as mortgagee, as nominee for American Heritage Lending, LLC its successors and assigns and now held by Elizon Master Participation Trust I, U.S. Bank Trust National Association, as Owner Trustee, said mortgage dated December 22, 2023, and recorded in the Plymouth County Registry of Deeds in Book 58558, Page 62, as affected by an Assignment of Mortgage dated August 20, 2024, and recorded in the Plymouth County Registry of Deeds in Book 59190, Page 137, of which mortgage the undersigned is the present holder, for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on August 13, 2026 at 03:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
Parcel 1
The land with the buildings thereon in Plymouth, Plymouth County, Massachusetts, on the Southerly side of Summer Street, being known and numbered as 230 Summer Street and being shown as lot 32A-16 on a plan entitled "Definitive Subdivision Plan Of Land in Plymouth, Plymouth County, MA Scale 1" = 40' date August 18, 1987 Owned by Rare Enterprises, Inc., 230 Summer Street, Plymouth, MA Revisions, 10-16-87" recorded as Plan 1387 of 1987 (sheets 1 through 4).
Exception therefrom, that certain parcel of land being shown as Parcel A on a plan entitled "Lot Line Adjustment Plan of Land at Lots 32A-16A & 17, Assessor Map 100 in Plymouth, Massachusetts prepared for KJM Realty Trust, dated April 26, 1994, prepared by Land Management Systems, and recorded in Plan Book 37, Page 485, Plan Number 911 of 1994 which was conveyed by deed recorded in Book 13330, Page 258.
Subject to and with the benefit of 20' wide emergency road easement as shown on said plan, open space easement and 20' wide utility easement which are hereby reserved to the grantor for the benefit of its remaining lots as shown on the aforesaid plan.
Parcel 2
A certain parcel of land, with the improvements thereon, situated off the Northeasterly side of Thoreau Road in Plymouth, Plymouth County, Massachusetts, being shown as Parcel B on a plan entitled "Lot Line Adjustment Plan of Land at Lots 32A-16A & 17, Assessor Map 100 in Plymouth, Massachusetts Prepared for KJM Realty Trust" dated April 26, 1994, prepared by Land Management Systems, and recorded in Plan Book 37, Page 485, Plan Number 911 of 1994.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor's Title see deed dated April 21, 2023, and recorded in the Plymouth County Registry of Deeds in Book 57891, Page 217.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within forty-five (45) days after the date of sale.
