MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by David J. Delgizzi to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for First Horizon Home Loan Corporation, its successors and assigns, dated October 17, 2005 and recorded in Barnstable County Registry of Deeds in Book 20369, Page 83 (the “Mortgage”) of which mortgage The Bank of New York, Mellon, as Trustee for First Horizon Alternative Mortgage Securities Trust 2005-AA11 is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as nominee for First Horizon Home Loan Corporation, its successors and assigns to The Bank of New York Mellon f/k/a The Bank of New York. as Trustee for the Holders of the Certificates, First Horizon Mortgage Pass-Through Certificates Series FHAMS 2005-AA11, by First Horizon Home Loans, a division of First Tennessee Bank National Association, Master Servicer, in its capacity as agent for the Trustee under the Pooling and Servicing Agreement dated July 25, 2013 and recorded at said Registry of Deeds in Book 27599, Page 274, and Assignment from Mortgage Electronic Registration Systems, Inc. as nominee for First Horizon Home Loan Corporation, its successors and assigns to The Bank of New York, Mellon, as Trustee for First Horizon Alternative Mortgage Securities Trust 2005-AA11 dated November 20, 2014 and recorded at said Registry of Deeds in Book 28567, Page 221, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 14 Brewster Cross Road, Orleans, MA 02653 will be sold at a Public Auction at 12:00 PM on August 14, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The land in Orleans, Barnstable County, Massachusetts, together with the buildings thereon, bounded and described as follows:
SOUTHERLY by Cross Road, also known as Brewster Cross Road;
WESTERLY by land now or formerly of the Heirs of John E. Varnum and Elvira Nickerson, and now or formerly occupied and claimed by Nancy Varnum Eldredge;
NORTHERLY by land now or formerly of Warren M. Hopkins et ux; and
EASTERLY by land now or formerly of George O. Ober.
Containing an area of one (1) acre.
For mortgagor’s title see deed recorded with the Barnstable County Registry of Deeds in Book 20369, Page 80.
The property will be sold subject to the redemption rights in favor of the Internal Revenue Service by virtue of the tax lien(s) recorded in Barnstable County Registry of Deeds in Book 34274, Page 129.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
