NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by 6 Morse, LLC dated November 21, 2022 (“Mortgage”) to Alltrust Credit Union and recorded on November 22, 2022 in the Norfolk County, MA Registry of Deeds in Book 40934, Page 31, of which Mortgage the undersigned is the present holder, for breach of conditions of said Mortgage and for the purpose of foreclosing the same, will be sold at PUBLIC AUCTION at 10:00 AM on August 25, 2026, on the mortgaged premises located at 6 Morse Street, Quincy, MA 02170 (the “Premises”), all and singular, the premises as described in the Mortgage, to wit:
The land at 6 Morse Street, Quincy, Norfolk County, Massachusetts with the buildings thereon, situated in that part of Quincy called Wollaston, comprising the Northeasterly one-half of Lots 70 and 71, bounded and described as follows:
Southeasterly by Morse Street, as shown on the plan hereinafter mentioned, fifty and 00/100 (50.00) feet;
Northeasterly by Lot 72, as shown on said plan, ninety and 00/100 (90.00) feet;
Northwesterly by Lot 69, as shown on said plan, fifty and 00/100 (50.00) feet; and
Southwesterly by the remaining portions of Lots 70 and 71, as shown on said plan, ninety and 00/100 (90.00) feet;
Being shown as comprising the Northeasterly one-half of Lots 70 and 71 on a plan entitled “Plan of Sea Shore Lots owned by the Wollaston Land Associates”, dated June, 1895, by H.T. Whitman, Surveyor, recorded with Norfolk County Registry of Deeds, Plan Book 26, Plan 1166.
Being the same premises conveyed to this grantor by Foreclosure Deed of Bank of America, N.A., and recorded in the Norfolk County, MA Registry of Deeds on January 10, 2022 in Book 40230, Page 226.
TERMS OF SALE:
The Premises are being sold SUBJECT TO any and all unpaid real estate taxes, water rates, municipal charges and assessments, condominium charges, expenses, costs, and assessments, if applicable, federal tax liens, partition wall rights, statutes, regulations, zoning, subdivision control, or other municipal ordinances or bylaws respecting land use, configuration, building or approval, or bylaws, statutes or ordinances regarding the presence of lead paint, asbestos or other toxic substances, sanitary codes, housing codes, tenancy, and, to the extent that they are recorded prior to the above mortgage, any easements, rights of way, restrictions, confirmation or other matters of record. A deposit of Fifteen Thousand ($15,000.00) Dollars (the “Deposit”) by certified or bank check only payable to Alltrust Credit Union will be required to be paid at the time and place of the sale. The balance of the purchase price is to be paid within thirty (30) days from the date of sale. Payment of the balance of the purchase price shall also be paid by certified or bank cashier’s check payable to Alltrust Credit Union, or by wire transfer. The successful bidder shall be required to sign a Memorandum of Sale of Real Property in a form to be prepared by Mortgagee’s counsel containing the above terms and any other terms announced at the time and place of the sale. TIME SHALL BE OF THE ESSENCE.
The Mortgagee reserves the right to postpone the sale to a later date by public proclamation at the time and date appointed for the sale and to further postpone at any adjourned sale-date by public proclamation at the time and date appointed for the adjourned sale date.
In the event that the successful bidder at the foreclosure sale shall default in purchasing the Premises according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed by said bidder, the Mortgagee reserves the right to sell the Premises to the second highest bidder subject to said second highest bidder complying with the deposit and remaining purchase price payment terms as required by the Mortgagee.
The description of the Premises contained in said mortgage shall control in the event of an error in this publication.
