Brian Hyps and any unknown occupants of 3616 Barrington Place NW, Canton, OH 44708, will take notice that on October 6, 2025, the undersigned, Barrington Place Condominium Association, Inc. filed a Complaint in the Stark County Court of Common Pleas, 115 Central Plaza North, Canton, OH 44702, alleging that your Unit is located within the Association, that you were in violation of the Association's Declaration by permitting water to emanate from your Unit into Common Areas of the Association, that your Unit was damaged due to this water leak, that it was filled with debris, trash, and in a state of disrepair, that you refused to permit access to management to remediate the conditions, and your actions caused damage and insect infestation to neighboring Units.
Plaintiff demands judgment for the following relief:
Temporary, preliminary, and permanent njunction requiring Defendant to provide access to his Unit for the purpose of inspecting, maintaining, and abating the water leak and water damage in the Unit to prevent mold from spreading to the common elements and other units and to remove and abate any unsanitary conditions, which creates noxious odors and health and safety hazard;
A judgment in favor of Association and against Defendant for reimbursement of all costs incurred in entering Defendant's Unit and performing abatement work;
A judgment in favor of Association and against Defendant Brian Hyps for reimbursement of all costs, expenses and attorneys' fees incurred by the Association in connection with this action;
Such other relief as this Court deems fair and equitable.
The Defendant named above is required to answer on or before the 21st day of August, 2026.
