NOTICE OF HEARING
PETITION FOR PARTIAL CLOSING OF CATTAIL-KETTLE LAKE
Notice is hereby given that the South Dakota Department of Game, Fish and Parks Commission has received a petition to close a portion of Cattail-Kettle Lake for recreational use year-round. This petition was received from landowner Chris Schuster.
In accordance with SDCL 41-23-9 and South Dakota Administrative Rule 41:04:06, a petition dated August 22, 2025, requests the closure of a portion of Cattail-Kettle Lake to recreational use. A hearing will take place at 10:00 am (MT) on October 9, 2025, at the Beeler Community Center, 203 Main Ave, Lemmon, SD.
This hearing is an adversary proceeding held in accordance with SDCL 1-26. Any interested party is strongly encouraged to attend the hearing. Interested persons will be given reasonable opportunity to submit data, opinions, arguments, and their views, either orally or in writing (or both) at the hearing. All interested parties have the right to be heard at the hearing and/or to be represented by a lawyer. The decision of the commission may be appealed to the Circuit Court and the State Supreme Court as provided by law. Special notice is given that if an interested party is a corporation, they must be represented by legal counsel at contested case hearings under South Dakota case law.

If the amount in controversy exceeds two thousand five hundred dollars or if a property right may be terminated, any party to the contested case may require the agency to use the Office of Hearing Examiners by giving notice of the request to the agency no later than ten days after service of a notice of hearing issued pursuant to SDCL 1-26-17.
