NOTICE OF FORECLOSURE SALE
FIRST PREMIER BANK, Plaintiff,
v.
MICHAEL J. KAPPES, and U.S. BANK TRUST NATIONAL ASSOCIATION AS TRUSTEE FOR TRUMAN 2021 SD9 TITLE TRUST, and ANY PARTY IN POSSESSION, Defendants.
An Amended Judgment and Decree of Foreclosure (the "Judgment") dated August 26, 2025, was entered on the same day by the Circuit Court for the Second Judicial Circuit, Minnehaha County in the action entitled First Premier Bank v. Michael J. Kappes, et al, 49CIV 25-002252. The Judgment, in part, directed a foreclosure sale of the following described real property in Minnehaha County, South Dakota:
The East 1167.06 Feet of the South 417.42 Feet and the North 5 Feet of the South 422.42 Feet of the West 175 Feet of the East 878.22 Feet of the Southeast Quarter of the Southwest Quarter (SE1/4SW1/4) of Section 35, Township 103 North, Range 50 West of the 5th P.M., Minnehaha County, South Dakota.
This real property is commonly known as 47036 256th Street, Crooks, SD 57020.
NOTICE IS HEREBY GIVEN that for the purpose of realizing the sum of $62,636.12 on the Note and Mortgage, such sum being the Judgment amount as of August 26, 2025, against Defendant Michael J. Kappes, plus subsequently accruing interest, costs, fees and expenses of foreclosure and other amounts lawfully added to such Judgment, and pursuant to such Judgment, the above-described real property will be sold at public auction to the highest bidder for cash, by the Sheriff of Minnehaha County, at the front lobby of the Law Enforcement Center at 320 W. 4th Street, Sioux Falls, South Dakota at 11:00 A.M., on Wednesday, October 8, 2025. The real property is that described in a Mortgage –180 Day Redemption, dated April 4, 2007, and recorded with the Minnehaha County Register of Deeds Office on April 13, 2007, in Book 1567 of Mortgages on Page 166, executed and delivered by Michael J. Kappes. The property will be sold as one distinct parcel. The Plaintiff reserves the right to cancel or reschedule the sale from time-to-time.
