NOTICE OF
TOTAL MAXIMUM DAILY LOAD ADDENDUM DOCUMENT:
AN OPPORTUNITY FOR PUBLIC COMMENT
The South Dakota Department of Agriculture and Natural Resources (DANR) is announcing the availability of the following Total Maximum Daily Load (TMDL) addendum for review and comment.
2026 Addendum to the South Dakota Statewide Mercury TMDL
This TMDL addendum was developed at a watershed scale with public involvement in accordance with section 303(d) of the federal Clean Water Act.
The 2026 South Dakota Integrated Report for Surface Water Quality Assessment identified Cookstove Lake (SD-BA-L-COOKSTOVE_01) as not supporting designated aquatic life uses due to increased levels of methyl-mercury in fish tissue. As a result, this waterbody was placed on the 303(d) list of impaired waters and requires a TMDL.
A TMDL defines existing pollutant loading of all waste load allocations from point source discharges and remaining load allocations from nonpoint sources, plus a margin of safety to account for uncertainty. A TMDL also establishes the amount of pollutant loading reduction required to bring a waterbody into compliance with water quality criteria. The draft TMDL for the aforementioned waterbody was developed as an addendum to the 2016 Statewide Mercury TMDL. https://danr.sd.gov/Conservation/WatershedProtection/TMDL/docs/TableDocs/tmdl_statewidemercury.pdf.

Persons are encouraged to access the document and submit comments electronically through the Public Notice page by using the online comment form accessible via the "Comment Deadline" link. A copy of the TMDL addendum document may also be requested by calling (605) 773-3623, emailing DANRMail@state.sd.us, or by mail at the address below. Comments can be submitted via email or by writing to the respective addresses. The department must receive comments by August 15, 2026.
