MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Lisa M. O'Connor to "MERS", Mortgage Electronic Registration Systems, Inc., a separate corporation that is acting solely as nominee for Fairway Independent Mortgage Corporation, "Lender"; and its successors and assigns dated November 17, 2017 and recorded with the Worcester County (Worcester District) Registry of Deeds, in Book 58060, Page 159, as assigned by Assignment of Mortgage dated March 16, 2021; recorded in Worcester County (Worcester District) Registry of Deeds, Book 64709, Page 227, and by Assignment dated October 25, 2022; recorded in Worcester County (Worcester District) Registry of Deeds, Book 68467, Page 251, and by Assignment dated November 11, 2024; recorded in Worcester County (Worcester District) Registry of Deeds, Book 71282, Page 135, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 12:00 PM, on March 4, 2026, on the premises known as Unit No. 73 of the Sturbridge Hills Condominium, 73 Colonial Drive, Sturbridge, Massachusetts, the premises described in said mortgage, together with all the rights, easements, and appurtenances thereto, to wit:
Unit No. 73 (the "Unit") of Sturbridge Hills Condominium, a condominium located at 333 Main Street, Sturbridge, Worcester County, Massachusetts created by Master Deed dated September 12, 1988 and recorded September 27, 1988 with Worcester District Registry of Deeds in Book 11641, Page 171, as amended by instruments of record (hereinafter referred to as "Master Deed") together with the undivided percentage interest in the common areas and facilities of said Condominium as set forth in Master Deed, as amended.
Said Unit 73 contains 2,415 square feet, more or less, and is laid out as shown on a plan attached hereto Deed recorded with said Registry of Deeds in Book 25582, Page 120, to which is affixed a verified statement in the form prescribed by Massachusetts General Laws, Chapter 183A, Section 9, and which plan is a portion of the plans filed with said Master Deed, as amended.
Said Unit is conveyed together with:
(a) Its undivided percentage interest in the common areas and facilities described in said Master Deed, as amended.
(b) the benefit of and subject to, all easements, rights observations, restrictions, agreements and provisions contained in said Master Deed, the Declaration of Trust creating Sturbridge Hills Condominium Trust and the By-Laws contained therein, all as recorded with Worcester District Registry of Deeds in Book 11641, Page 188, as the same may be amended or record and the Rules and Regulations from time to time promulgated thereunder as authorized therein, and including without limitations, the restrictions set forth in said Master Deed, as amended, the Plans filed therewith, said Declaration of Trust and the By-Laws contained therein (as the same may from time to time be amended by instrument duly recorded with said Deeds) which are hereby incorporated by reference and constitute covenants running with the land and are and shall remain binding upon any person or persons having at any time any interest or estate in this Unit and personas having at any time any interest or estate in this Unit and persons claiming through or under them.
This Unit is also made subject to and with the benefit of the provisions of said General Laws, Chapter 183A, as now in force and as from time to time amended, and subject also to (a) municipal taxes attributable to such Unit and common areas and facilities, assessed as of the current tax year and that are not yet due and payable, which Grantee, by accepting this Unit Deed, assumes and agrees to pay; and (b) building and zoning laws.
Being the same premises conveyed to Joan M. Rougemont by Deed of Peter C. Hapgood and Susan L. Hapgood dated July 1, 2003, and recorded with the Worcester District Registry of Deeds in Book 30664, Page 85.
Terms of Sale: These premises are being sold subject to any and all unpaid real estate taxes, water rates, municipal charges and assessments, condominium charges, expenses, costs, and assessments, if applicable, federal tax liens, partition wall rights, statutes, regulations, zoning, subdivision control, or other municipal ordinances or bylaws respecting land use, configuration, building or approval, or bylaws, statutes or ordinances regarding the presence of lead paint, asbestos or other toxic substances, sanitary codes, housing codes, tenancy, and, to the extent that they are recorded prior to the above mortgage, any easements, rights of way, restrictions, confirmation or other matters of record.
The purchaser shall also bear all state and county deeds excise tax. The deposit of $10,000.00 is to be paid in cash or bank or certified check at the time and place of the sale, with the balance of the purchase price to be paid by bank or certified check within forty-five (45) days after the date of the sale, to be deposited in escrow with Guaetta and Benson, LLC, at 73 Princeton Street, Suite 208, North Chelmsford, Massachusetts.
In the event that the successful bidder at the foreclosure sale shall default in purchasing the within described property according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by foreclosure deed to the second highest bidder or, thereafter, to the next highest bidders, providing that said bidder shall deposit with said attorney, the amount of the required deposit as set forth herein within five (5) business days after written notice of the default of the previous highest bidder.
Other terms, if any, are to be announced at the sale.
