NOTICE OF HEARING
TO WHOM IT MAY CONCERN:
In compliance with the pertinent provisions of the Borough of Bellmawr Zoning and Land Development Ordinance, and the New Jersey Municipal Land Use Act, N.J.S.A. 40:55D-1 et seq., notice is hereby given that a written application has been filed by the undersigned Applicant with the Borough of Bellmawr Joint Land Use Board seeking the following relief, all in the alternative: 1) appeal of the Bellmawr Borough Zoning Officer's January 22, 2025 Notice of Violation claiming the occupancy of the subject property (identified below) by a group of individuals in recovery, known as a Cooperative Sober Living Residence ("CSLR"), constitutes a boarding house which is not a permitted use in the Office Zoning District; and/or 2) for a favorable interpretation of the Zoning Ordinance pursuant to N.J.S.A. 40:55D-70(b) that a CSLR constitutes a single housekeeping unit, and therefore is a family as a matter of law, whereby the occupancy of the property by the CSLR constitutes a continuation of the pre-existing nonconforming residential use of the property; and/or 3) Use Variance Relief pursuant to N.J.S.A. 40:55D-70d(1) to permit the continued occupancy of the existing two-family residential dwelling as a CSLR within the Office Zoning District. The requested relief pertains to the property shown as Lot 23.01 in Block 101.01 on the Borough of Bellmawr Tax Map, which property is located at 105 East Browning Road in the Borough of Bellmawr, Camden County, New Jersey. The within application further supports Applicant's previously-filed appeal of the Zoning Officer's January 22, 2025 Notice of Violation, which appeal was separately filed by the Applicant on February 11, 2025 in accordance with N.J.S.A. 40:55D-72(a).
Public hearing on the above-mentioned application has been scheduled for January 12, 2026, at 7:00 P.M. in the Borough of Bellmawr Municipal Building, 21 East Browning Road, Bellmawr, NJ 08031, at which time and place any interested party (as defined in N.J.S.A. 40:55D-4) will have an opportunity to be heard.
All documents relating to this application may be inspected by the public during regular business hours in the Office of the Planning/Zoning Department located at the Borough of Bellmawr Municipal Building, 21 East Browning Road, Bellmawr, NJ 08031. Please take further notice that the Board may, in its discretion, adjourn, postpone or continue said hearing from time to time and you are hereby notified that you should make diligent inquiry of the Planning/Zoning Department concerning such adjournments, postponements or continuations.
