NOTICE OF HEARING
Pursuant to N.J.S.A. 40:55D-12
PLEASE TAKE NOTICE that the Zoning Board of Adjustment of the Borough of Belmar ("Board") will hold a public hearing on Thursday, May 28, 2026 at 6:00 p.m. at the Belmar Municipal Building, located at 601 Main Street, Belmar, New Jersey to consider the application of Melinda Basaran ("Applicant") for premises known as Lot 1 in Block 190 as shown on the Official Tax Map of the Borough of Belmar and located 1900 Ocean Avenue, Belmar, New Jersey ("Property"). The Property is as corner lot with frontage on Ocean Avenue and Nineteenth Avenue.
The Property, which is located in the Borough's R-50 Single-Family Residential Zone District ("R-50 Zone"), contains a pre-existing, nonconforming 2-story, 2-family dwelling with a basement, freestanding garage, and related site improvements. Two-family dwellings are not a permitted use in the R-50 Zone. Each of the dwelling units contains 3 bedrooms for a total of 6 bedrooms. Applicant seeks approval for the reconstruction of and additions to the existing building including reconfiguring interior space, converting the basement to a crawl space and adding a habitable attic with access to a roof deck. The resulting building will continue to have 2 dwelling units of 3 bedrooms in each for a total of 6 bedrooms. Applicant also proposes to renovate the existing flat roofed free-standing garage, including adding a non-habitable attic addition for storage only above the existing garage, along with related site improvements.
In conjunction with the application, Applicant seeks use variance relief pursuant to N.J.S.A. 40:55D-70.d.2 to permit the expansion of the pre-existing, nonconforming two-family structure/use and pursuant to N.J.S.A. 40:55D-70.d.4 to permit a floor area ratio of 67.4%, whereas a maximum of 65% is permitted.
Additionally, Applicant seeks bulk variance relief pursuant to N.J.S.A. 40:55D-70.c as follows:
Front yard (Nineteenth Avenue) setback to principal building of 19.66 feet, whereas a minimum of 20 feet is required and 19.8 feet exists.Front yard (Ocean Avenue) setback to principal building of 19.81 feet, whereas a minimum of 20 feet is required and 19.8 feet exists.Rear yard setback to principal building of 23.91 feet, whereas a minimum of 35 feet is required and 17.4 feet exists.Side yard setback to principal building of 3.9 feet, whereas a minimum of 5 feet is required and 3.9 feet exists. This condition is being exacerbated vertically.Principal building setback to garage of 6.27 feet, whereas a minimum of 10 feet is required and 0 feet exists.Garage building height of 2 stories, whereas a maximum of 1 story is permitted. The garage conforms to the building height in feet at 16.37 feet, whereas a maximum of 18 feet is permitted.Building coverage (buildings and roofed areas) of 44.5%, whereas a maximum of 30% is permitted.Impervious coverage of 66.4%, whereas a maximum of 55% is permitted and 70.6% exists, resulting in an improvement of this condition.Two (2) off street parking spaces, whereas 4 off-street parking spaces are required by the Borough's Ordinance the State's Residential Site Improvement Standards, and 2 spaces exist. This is an existing condition that is not changing.
Applicant also expressly makes application for any additional exceptions, waivers, variances, interpretations and other approvals as reflected on the filed plans (as same may be further amended from time to time without further notice) and as may be determined to be necessary by the Board during the review and processing of the application.
PLEASE TAKE FURTHER NOTICE that you are privileged to be present at said public hearing to present any and all comments you may have to the granting of said approvals. The hearing may be continued without further notice on such additional or other dates as the Board may determine. The application and supporting documents are on file in the Board office located in the Municipal Building, 601 Main Street, Belmar, New Jersey and are available for inspection during the Borough's normal business hours.
