BOROUGH OF DEAL IN THE MATTER OF THE APPLICATION OF ICC NEPTUNE AVE LLC FOR PREMISES KNOWN AS LOT 1 IN BLOCK 83 ON THE OFFICIAL TAX MAP OF THE BOROUGH OF DEAL NOTICE OF HEARING Pursuant to N.J.S.A. 40:55D-12 PLEASE TAKE NOTICE that the Planning Board of the Borough of Deal ("Board") will hold a public hearing on Tuesday, March 24, 2026 at 7:30 p.m. in the Borough of Deal Meeting Room, 2nd Floor, Durant Square, 190 Norwood Avenue, Deal, New Jersey to consider the application of ICC Neptune Ave LLC ("Applicant") for premises known as Lot 1 in Block 83 as shown on the Official Tax Map of the Borough of Deal and located at 8 Neptune Avenue, Deal, New Jersey ("Property"). Applicant is seeking approval for the construction of an in-ground swimming pool, pool cabana, pool patio, fencing, walls, pool equipment, walkways, and related site improvements. In conjunction with the application, Applicant seeks bulk variance relief pursuant to NJSA 40:55D-70.c as follows: Pool cabana located in a front yard, whereas accessory structures are only permitted in a side/rear yard. Pool cabana height of 20 feet proposed, whereas a maximum height of 18 feet is permitted.Pool perimeter exposure above ground of 63%, whereas a maximum of 30% is permitted.Fence/wall/gate heights of 5 feet, 5.55 feet, and 6 feet in a front yard, whereas a maximum height of 3 feet is permitted. Applicant also expressly makes application for any additional exceptions, interpretations, waivers, variances and other approvals as reflected on the filed plans as same may be further amended from time to time without further notice and, as may be determined to be necessary by the Board or its professionals during the review and processing of the application. PLEASE TAKE FURTHER NOTICE that you are privileged to be present at said public hearing to present any and all comments you may have to the granting of said approvals. The hearing may be continued without further notice on such additional or other dates as the Board may determine.
