NOTICE OF HEARING
Pursuant to N.J.S.A. 40:55D-12
PLEASE TAKE NOTICE that the Planning Board of the Borough of Deal ("Board") will hold a virtual/remote public hearing on Tuesday, May 26, 2026 at 7:30 p.m. to consider the application of Michael Betesh ("Applicant") for premises known as Lot 7 in Block 79 as shown on the Official Tax Map of the Borough of Deal and located at 83 Richmond Avenue, Deal, New Jersey ("Property"). The Property is a corner lot with frontage on Richmond Avenue and Neptune Avenue.
This meeting is being held virtually/remotely via ZOOM. You are hereby notified that you are invited to participate in this remote hearing and present any and all comments you may have to the granting of said approvals. Instructions on how to access the meeting via are listed below.

Members of the public may contact the Board Secretary at (732) 531-1454 or planningboard@dealnj.gov to request a copy of the application documents including exhibits and plans either as an electronic copy via email or a hard copy by regular mail, subject to any standard fees or charges, or by appointment at the Municipal Building.
Members of the public should notify the Board Secretary in advance, if possible, via email or phone call of their intention to undertake cross-examination, introduce evidence and/or make public statements or comments to ensure technological needs are accommodated and documents that will be referenced are available for review by all participants.
THE APPLICATION:
The Property is located in the Borough's R-2 Residential Zone District and currently contains a 2 ½-story, single-family dwelling with wood decking, a freestanding garage, asphalt driveway, walkways, and related site improvements. Applicant seeks approval for the following: remove the rear wooden decking and construct an in-ground swimming pool and pool patio, pool fence, pool equipment; remove portions of the existing driveway and replace with lawn; and, related site improvements.
The Property and structures are existing, nonconforming as follows: lot area of 15,000 square feet, whereas a minimum of 18,750 square feet is required; lot width of 100 feet, whereas a minimum of 150 feet is required; front yard setbacks (Richmond Avenue) of 38 feet to covered porch, whereas a minimum of 50 feet is required; side yard setback of 13.3 feet, whereas a minimum of 20 feet is required; garage rear and side yard setbacks of 3.6 feet and 2.9 feet, whereas a minimum of 10 feet is required; driveway front yard width 36.4 feet whereas a maximum of 20 feet is permitted; driveway front yard coverage of 35.4%, whereas a maximum of 35% is permitted; driveway side yard coverage of 100%, whereas a maximum of 50% is permitted; and, impervious coverage of 42.8%, whereas a maximum of 40% is permitted. This nonconformity is proposed to be eliminated.
In conjunction with the application, Applicant seeks bulk variance relief pursuant to NJSA 40:55D-70.c for pool rear yard setback of 20 feet, whereas a minimum of 30 feet is required. The nonconformities related to impervious coverage, driveway coverage and driveway width are all proposed to be eliminated.
Applicant also expressly make application for any additional exceptions, interpretations, waivers, variances and other approvals as reflected on the filed plans as same may be further amended from time to time without further notice and, as may be determined to be necessary by the Board or its professionals during the review and processing of the application.
PLEASE TAKE FURTHER NOTICE that you are privileged to attend this virtual/remote public hearing either by web conference or telephone as outlined above to present any and all comments you may have to the granting of said approvals. The hearing may be continued without further notice on such additional or other dates as the Board may determine. The application and supporting documents are on file with the Board located at the Borough Hall, 190 Norwood Avenue, Durant Square, Deal, New Jersey and are available for inspection as outlined above.
