BOROUGH OF EAST RUTHERFORD ZONING BOARD OF ADJUSTMENT
NOTICE OF HEARING
PLEASE TAKE NOTICE that the applicant, Gesly Torres, through its undersigned attorneys, Friend & Wenzel, LLC, has filed an application for development with the Zoning Board of Adjustment of the Borough of East Rutherford requesting a "Use" Variance pursuant to N.J.S.A. 40:55D-70(d)(1); Height Variance pursuant to N.J.S.A. 40:55D-70(d)(6); Bulk variances and Waivers pursuant to N.J.S.A. 40:55D-70(c)(1) and/or (2) so as to construct a new two-family dwelling. The current lot is vacant. The subject property is designated as Block: 17 Lot: 7 on the Tax Map of the Borough of East Rutherford, and located at 39 Wall Street, East Rutherford, New Jersey in the R-2 Zoning District. Pursuant to N.J.S.A. 40:55D-12, this notice is sent to you as an owner of property in the immediate vicinity.
In connection with this application, the applicant will also request the following variances and waivers from the East Rutherford Zoning Ordinance:
USE: Applicant proposes a two-family residence on an undersized lot which is not permitted in the R-2 Zoning District. HEIGHT: Applicant proposes a structure who total height is 38 feet and the height allowed is 30 feet in the R-2 Zoning District. BULK: (1) Min. lot area of 3,737 sq. ft where 6,000 sq. ft. is required, (2) Min. lot width of 39 ft. where 60 ft. is required, (3) Max. building coverage of 27% where 25% is allowed, (4) 3 stories where 2 ½ stories is allowed, (5) Driveway width in excess of 32% of lot width, and (6) Total living space in each unit is less than 1000 sq. ft. WAIVERS: Site Plan review (§327-18) is not required for two-family dwellings and waivers are sought for all provisions thereunder.
The applicant will also apply for such other variances, waivers and/or exceptions as shall become necessary or apparent during the course of the application review and/or public hearing. This notice is sent to you as required by the N.J.S.A. 40:55D-1 et. seq., the Municipal Land Use Law (hereinafter "MLUL") as well as the Code of the Borough of East Rutherford.
A public hearing has been scheduled for May 7, 2026 at 7:00 P.M. in the Municipal Building, located at One Everett Place, East Rutherford, New Jersey. When the case is called you may appear either in person or by attorney and present any objections which you may have to the granting of the relief sought in the petition. The application, plans, exhibits, reports and other pertinent documents are on file in the Office of William Justis, Secretary of the Zoning Board of Adjustment located at One Everett Place, East Rutherford, New Jersey 07073 and are available for inspection during normal business hours, Monday through Friday except Legal Holidays.
