LEGAL NOTICE OF HEARING
PLEASE TAKE NOTICE that 303 Lakeside LLC has applied to the Land Use Board of the Borough of Hopatcong to demolish the existing single-family dwelling and construct a single-family dwelling consisting of 3,067 square feet, detached garage, new driveway with retaining wall, and associated improvements for property located at 303 Lakeside Boulevard, Hopatcong, designated as Block 30501, Lot 2 on the Borough of Hopatcong Tax Map and located in the R-1 Residential Zone.
Applicant requests variances from 1) §242-38.D(1) which states the minimum lot size of 15,000 sq. ft. is required where the existing lot size of 14,400 sq. ft. is proposed to remain; 2) §242-38.D(2) which states the minimum lot width of 120 feet is required where the existing lot width of 68.4 feet is proposed to remain; 3) §242-38.D(6) which states the minimum rear yard setback of 6 feet is required for accessory structures where a rear yard setback of 0 feet for the existing boathouse is proposed to remain; 4) §242-18A which states no structure shall be constructed within 50 feet of lake where the existing boathouse is proposed to remain within 50 feet of the lake; 5) §242-38.D(4) which states the minimum front yard setback of 40 feet is required where a front yard setback of 26 feet is proposed for the garage; 6) §242-38.D(5) which states the side yard setback of 15 feet is required for accessory structures where a side yard setback of 7 feet for the garage is proposed; 7) §242-38.E(1) which states the maximum building coverage of 20% is permitted where the building coverage of 21.3% is proposed; 8) §242-38.E(2) which states the maximum lot coverage of 35% is permitted where the lot coverage of 41.2% is proposed (30.7% without roadway pavement); 9) §242-12.B(2) which states the maximum disturbance of steep and critical slopes is 2,500 square feet where the steep and critical slopes disturbance of 5,000 square feet is proposed; 10) §242-11.C which states no building or structure shall be located on any critical or steep slope area where the dwelling and garage are proposed on a critical or steep slope area; 11) §242-28.C(1) which states the minimum setback for a retaining wall of 5 feet is required where a setback of 1.9 feet is proposed for the retaining wall; 12) §242-15.B(5) which states no accessory structure shall be permitted in front yard where the garage is proposed in the front yard; 13) §242-15.E which states not more than 2 accessory structures are permitted where 3 accessory structures, the existing shed and boathouse and the proposed garage, are proposed; and 14) §242-15.G which states the minimum side yard setback of 4 feet is required for sheds where a side yard setback of 3.9 feet for the shed is proposed to remain. Applicant also requests such other variances, waivers, permits, approvals or licenses that are deemed necessary or appropriate by the Board.
A public hearing will be held on September 16, 2025 at 7:00 P.M. at the Borough of Hopatcong Municipal Building, located at 111 River Styx Road, Hopatcong, New Jersey 07843. All persons interested in said application may appear in person, or by agent or attorney, to participate in the meeting and present any objections that they may have to the granting of the relief sought and/or to provide public comment at the appropriate time.
Plans and other documentation relating to this application will be on file and available for public inspection at least ten (10) days before the hearing during normal business hours in the Building Department office located in the Borough of Hopatcong Municipal Building, 111 River Styx Road, Hopatcong, New Jersey 07843.
