ORDINANCE NO. 26-CODE-983
An Ordinance of the Borough of Oakland, County of Bergen, State of New Jersey, Repealing and Replacing Chapter 18, Affordable Housing of the Borough Code
PLEASE TAKE NOTICE that the Mayor and Council of the Borough of Oakland have introduced Ordinance 26-Code-983, which repeals and replaces existing affordable housing provisions in Chapter 60 and Chapter 18 of the Borough Code and establishes a comprehensive new Affordable Housing and Development Fee Ordinance consistent with the State's Fourth Round affordable housing requirements.
The ordinance is introduced in response to amendments to the New Jersey Fair Housing Act (P.L. 2024, c.2), the Fourth Round regulations at N.J.A.C. 5:99, and the Uniform Housing Affordability Controls (UHAC) at N.J.A.C. 5:80-26.1 et seq., and implements the Borough's Fourth Round Housing Element and Fair Share Plan
The ordinance establishes updated standards and procedures for:
Administration, monitoring, and reporting of affordable housing obligations;Borough-wide mandatory affordable housing set-aside requirements for qualifying developments;Development fees for residential and non-residential projects;Affordable housing trust fund management and spending plans;Rehabilitation and new construction affordable housing programs;Affordability controls, pricing standards, bedroom distribution, and income limits;Accessibility requirements;Supportive housing and assisted living provisions; andAffirmative marketing requirements to ensure fair and equitable access to affordable housing.
NOTICE:
The above ordinance was introduced at a meeting of the Mayor and Borough Council held on February 24, 2026. Adoption of this ordinance will be considered at a meeting to be held at the Municipal Court/Council Chambers 10 Lawlor Drive, Oakland, N.J. on March 12, 2026 commencing at 7:00 p.m., at which time and place all persons interested therein or affected thereby will be given an opportunity to be heard concerning same. Copies of this ordinance are available at the Municipal Building up to the time of the public hearing for members of the public who request the same.
