An Ordinance to Amend Section 59-53.1.1 of the Borough Code to Revise the Permitted Density and Required Affordable Housing Set-Aside in the Downtown 1 Affordable Housing Overlay Zone
PLEASE TAKE NOTICE that the Mayor and Council of the Borough of Oakland have introduced Ordinance No. 26-CODE-984, which amends Section 59-53.1.1 of the Borough Code to revise the permitted residential density standards and the required affordable housing set-aside within the Downtown 1 Affordable Housing Overlay Zone.
The purpose of this ordinance is to modify development standards applicable within the Downtown 1 Affordable Housing Overlay Zone in order to align permitted density and affordable housing requirements with the Borough's current Housing Element and Fair Share Plan and applicable State affordable housing regulations. The ordinance updates the percentage of required affordable housing units and adjusts the permitted density to ensure compliance with the Borough's constitutional and statutory affordable housing obligations while maintaining appropriate development controls within the downtown area.
The above ordinance was introduced at a meeting of the Mayor and Borough Council held on February 24, 2026. Adoption of this ordinance will be considered at a meeting to be held at the Municipal Court/Council Chambers, 10 Lawlor Drive, Oakland, N.J., on March 12, 2026 commencing at 7:00 p.m., at which time and place all persons interested therein or affected thereby will be given an opportunity to be heard concerning same. Copies of this ordinance are available at the Municipal Building up to the time of the public hearing for members of the public who request the same.
