ZONING BOARD OF ADJUSTMENT
NOTICE OF HEARING
TO WHOM IT MAY CONCERN:
In compliance with the pertinent provisions of the Borough of Ringwood Planning and Zoning Code, and the New Jersey Municipal Land Use Act, N.J.S.A. 40:55D-1 et seq., notice is hereby given that a written application has been filed by the undersigned with the Borough of Ringwood Zoning Board of Adjustment seeking the following relief, all in the alternative: (1) a favorable ordinance interpretation pursuant to N.J.S.A. 40:55D-70(b) that the existing Cooperative Sober Living Residence (CSLR) constitutes a single housekeeping unit which is a single-family residential use of the property and therefore is a permitted use in the R-40 Zoning District where the property is situated; and/or (2) Use Variance Relief pursuant to N.J.S.A. 40:55D-70d(1) to permit the continued occupation of the single-family home as a CSLR within the R-40 Zone; and/or (3) a Reasonable Accommodation in the conduct of the Board's interpretation of the zoning ordinance, and/or consideration of the alternative request for use variance relief, as required under the mandates of the Federal Fair Housing Act and the Americans with Disabilities Act; together with any and all other variances or waivers the Board may reasonably require in the exercise of its discretion and without further public notice. This application concerns property shown as Block 201, Lot 20.02 on the Borough of Ringwood Tax Map, which property is located at 8 Maria Court, and is situated within the R-40 Zoning District.
At a public hearing held before the Borough of Ringwood Zoning Board of Adjustment on April 20, 2026, the Zoning Board denied Applicant's interpretation request outlined above and commenced public hearing on the alternative request for use variance relief. Subsequent thereto on April 28, 2026, the Appellate Division issued an unpublished opinion in the matter of HEF Ventures, LLC v. Township of Hanover Zoning Board of Adjustment, under Appellate Division Docket No. A-2684-24. Based upon the Appellate Division's findings in that case relative to CSLRs, Applicant has requested and/or intends to request the Zoning Board reconsider its denial of the interpretation request. In the event the Board declines to reconsider the interpretation ruling and/or again denies the interpretation request, the Board will continue to hear Applicant's alternative request for use variance relief.
Public hearing on the above-mentioned application has been scheduled for June 15, 2026 at 7:30 p.m. located at the Ringwood Borough Hall, 60 Margaret King Avenue, Ringwood, New Jersey, 07456, at which time and place any interested party (as defined in N.J.S.A. 40:55D-4) will have an opportunity to be heard.
All documents relating to this application may be inspected by the public during regular business hours in the office of the Board Secretary of the Borough of Ringwood Zoning Board of Adjustment, 60 Margaret King Avenue, Ringwood, New Jersey, 07456. Please take further notice that the Board may, at its discretion, adjourn, postpone or continue said hearing from time to time and you are hereby notified that you should make diligent inquiry of the Board Office concerning such adjournments, postponements or continuations.
