NOTICE OF HEARING
Pursuant to N.J.S.A. 40:55D-12
PLEASE TAKE NOTICE that the Zoning Board of Adjustment of the Borough of West Long Branch ("Board") will hold a public hearing on Tuesday, March 17, 2026, at 7:00 p.m. in the Borough Hall, Council Chambers Room, 965 Broadway, West Long Branch, New Jersey to consider the application of Moses and Yvette Nasar ("Applicants") for premises known as Lot 216.01 in Block 60 as shown on the Official Tax Map of the Borough of West Long Branch and located at 304 Wall Street, West Long Branch, New Jersey ("Property").
The Property is located in the Borough's R-22 Low Density Residential Zone District and currently contains a 2 story single-family dwelling, detached garage, shed, play area, asphalt driveway and related site improvements. The Property and structures are preexisting nonconforming as follows:
Lot width of 145.17 and lot frontage of 147.41 feet, whereas a minimum of 150 feet is required.Combined side yard setback of 49.9 feet, whereas a minimum of 50 feet is required.Garage rear yard setback of 14.9 feet, whereas a minimum of 16.06 feet is required.Garage building height of 16.06 feet, whereas maximum of 15 is permitted.Lot coverage of 42%, whereas a maximum of 30 is permitted.Rear yard coverage of 41.2%, whereas a maximum of 25% is permitted.
Applicants obtained a Zoning Permit dated September 9, 2020 and updated on June 7, 2023 ("ZP Approval") that allowed for reconstruction of the existing detached garage and renovations/addition to the existing home. The plan referenced in the ZP Approval shows a new single-family home and an addition to the garage ("Approved Plan"). The Approved Plan further shows a total impervious coverage of 34.19% and there is no reference on the Approved Plan or in the ZP Approval regarding rear yard coverage, which was nonconforming on the Approved Plan. After a majority of the construction had been completed, the ZP Approval was rescinded by the Zoning Officer via email on January 2, 2024 indicating it was issued in error and that variance relief is required.
When an as built survey was prepared in anticipation of an application, it was discovered that there was additional coverage over what was authorized in the now-rescinded ZP Approval. Applicants now seek approval to remove portions of the existing driveway, mulch play area and walkways in order to bring the total lot coverage and rear yard coverage as shown on the Approved Plan and as approved by the now-rescinded ZP Approval.
Accordingly, Applicants seek bulk variance relief pursuant to NJSA 40:55D-70.c as follows:
Lot width of 145.17 and lot frontage of 147.41 feet, whereas a minimum of 150 feet is required.Total lot coverage of 34.19%, whereas a maximum of 30% is permitted.Accessory structure rear yard lot coverage of 29.3%, whereas a maximum of 25% is permitted.House combined side yard setbacks of 49.9 feet, whereas a minimum of 50 feet is required.Garage area of 1,267 square feet, whereas a maximum area of 500 square feet is permitted.Shed area of 166 square feet, whereas a maximum of 150 square feet is permitted.Total accessory building area of 1,433 square feet, whereas a maximum of 700 square feet is permitted.Garage rear yard setback of 14.9 feet, whereas a minimum of 16.06 feet is required.Garage height of 16.06 feet, whereas a maximum of 15 feet is permitted.
Applicants also expressly make application for any additional exceptions, waivers, variances and/or other approvals as reflected on the filed plans (as same may be further amended from time to time without further notice) as may be determined to be necessary by the Board during the review and processing of the application.
PLEASE TAKE FURTHER NOTICE that you are privileged to be present at said public hearing to present any and all comments you may have to the granting of said approvals. The hearing may be continued without further notice on such additional or other dates as the Board may determine. The application and supporting documents are on file in the office of the West Long Branch Zoning Board of Adjustment, 965 Broadway, West Long Branch, New Jersey and are available for inspection during the Borough's normal business hours.
