NOTICE OF HEARING
Pursuant to N.J.S.A. 40:55D-12
PLEASE TAKE NOTICE that the Zoning Board of Adjustment of the Borough of West Long Branch ("Board") will hold a public hearing on Tuesday, March 17, 2026, at 7:00 p.m. in the Borough Hall, Council Chambers Room, 965 Broadway, West Long Branch, New Jersey to consider the application of David and Julie Botton ("Applicants") for premises known as Lot 21 in Block 46 as shown on the Official Tax Map of the Borough of West Long Branch and located at 465 Monmouth Road, West Long Branch, New Jersey ("Property"). The Property is a corner lot with frontage on Monmouth Road and West Palmer Avenue.
The Property is located in the Borough's R-22 Low Density Residential Zone District and currently contains a 2 story single-family dwelling, inground swimming pool and pool patio, asphalt basketball court, driveway, walkways, shed, and related site improvements. Applicants seek approval to reconstruct the swimming pool and pool patio, a portion of the existing fence, driveway, and related site improvements. The Property and structures are pre-existing, nonconforming as follows:
Lot area of 22,183 square feet, whereas a minimum of 22,500 square feet is required.Lot width of 119.8 feet, whereas a minimum of 150 feet is required.House front yard (West Palmer Avenue) setback of 29.9 feet, whereas a minimum of 35 feet is required.House side yard (south) setback of 13.9 feet, whereas a minimum of 20 feet is required.Shed side yard (south) setback of 3.7 feet, whereas a minimum of 10 feet is required.Basketball court in a front yard on a lot less than 30,000 square feet, whereas sport courts are only permitted on lots of 30,000 square feet or more and in side and rear yards. This nonconformity is proposed to be eliminated with the removal of the basketball court.Air conditioning unit side yard (south) setback of 8.7 feet, whereas a minimum of 10 feet is required.Generator side yard setback of 11.4 feet, whereas a minimum of 20 feet is located.Fence height in a front yard of 6 feet, whereas a minimum 3 feet is required.Accessory structure rear yard coverage of 38%, whereas a maximum of 25% is permitted.Impervious coverage of 39.6%, whereas a maximum of 30% is permitted.
In conjunction with the application, Applicants seek new bulk variance relief pursuant to NJSA 40:55D-70.c as follows:
Fence height in a front yard of 6 feet, whereas a maximum of 3 feet is permitted. This is a replacement of a small portion of existing 6-foot fence already in a front yard.Accessory structure rear yard coverage of 34%, whereas a maximum of 25% is permitted and 38% exists. This is an improvement over the existing condition. Impervious coverage of 39.6%, whereas a maximum of 30% is permitted and 40.6% exists. This is an improvement over the existing condition.
Applicants also expressly make application for any additional exceptions, waivers, variances and/or other approvals as reflected on the filed plans (as same may be further amended from time to time without further notice) as may be determined to be necessary by the Board during the review and processing of the application.
PLEASE TAKE FURTHER NOTICE that you are privileged to be present at said public hearing to present any and all comments you may have to the granting of said approvals. The hearing may be continued without further notice on such additional or other dates as the Board may determine. The application and supporting documents are on file in the office of the West Long Branch Zoning Board of Adjustment, 965 Broadway, West Long Branch, New Jersey and are available for inspection during the Borough's normal business hours.
