LEGAL NOTICE OF PUBLIC HEARING ON ORDINANCE ADOPTION
PLEASE TAKE NOTICE that at its meeting on September 25, 2025, the governing body introduced and approved on first reading Ordinance #2025-22C entitled:
AN ORDINANCE AMENDING CHAPTER 212, "ZONING," OF THE BOROUGH CODE OF THE BOROUGH OF BEACH HAVEN
This ordinance would reorganize Chapter 212, "Zoning," of the code of the Borough of Beach Haven. The purpose is to create a clearer and consolidated structure for the Borough's zoning regulations, including the adoption of Schedule #1, which identifies in a chart, area, yard, setback, building requirements coverage, and other requirements for all zones. In summary, the Ordinance:
1. Clarifies and reorganizes §§ 212-8 to 212-15.1 of the zoning code.
2. The new sections clarify regulations for each zoning district, including:
§ 212-9 (Single-Family Residential RA, RNA, RSA): Permits single-family dwellings, churches, schools, parks, public museums, libraries, professional offices, and customary home occupations.
§ 212-10 (Two-Family Residential RB): Permits all uses from the single-family districts and also allows for two-family dwellings.
§ 212-11 (Multifamily Residential RC): In addition to single-family uses, permits motels, hotels, apartments, and multifamily construction with specific density requirements.
§ 212-12 (Business District BD): Permits retail shops, restaurants, professional offices, and residential apartments located above first-floor commercial uses. It also establishes a conditional use process for converting commercial properties to new single-family dwellings.
§ 212-13 (Bed-and-Breakfast Overlay BBO): Permits owner- or manager-occupied dwellings providing lodging and meals to transient guests.
§ 212-14 (Marine Commercial MC): Permits marinas, boat sales and repairs, fish markets, restaurants, and related marine services.
§ 212-15 (Multifamily/Bay RCB): Permits retail establishments, service businesses, and boat slips, while allowing Marine Commercial uses on a conditional basis.
§ 212-16 (Historic Preservation District HP): Applies regulations from Chapter 41 to designated historic landmarks and provides exceptions for garage construction and yard setbacks to maintain the district's integrity.
3. Adds a new section (§ 212-17) that creates a comprehensive list of uses prohibited in all zones, including cannabis establishments, heliports, radio/telecommunications towers, mechanical amusement rides, and battery energy storage facilities within 5,000 feet of residential structures.
4. Adopts and incorporates by reference a new comprehensive chart, "Schedule #1: Schedule of Area, Yard, Setback, Building Requirements & Limits," to standardize development requirements across all zones.
5. Renumbers existing sections related to Signs, Fences, and Pools to align with the new structure.
