PLEASE TAKE NOTICE that an Application for Preliminary and Final Major Site Plan along with c(1) and c(2) bulk variances and design standard waivers and other relief as summarized below ("Application") has been filed on behalf of BAPS Clifton Fair Lawn, LLC ("Applicant") with the Borough of Fair Lawn Planning Board ("Board"). The property which is the subject of this application is designated as Block 5722, Lot 2 on the tax maps of the Borough of Fair Lawn and is also known as 17-17 to 17-77 River Road, Fair Lawn, New Jersey (the "Property"). The Applicant is the fee owner of the Property and this Application seeks approval from the Board as more fully described herein to conduct the use of a House of Worship.
The Property is located within the B-4 River Road Business Zone, and the Property and Application is also governed by the Ordinance Section 125-16B applicable to a House of Worship use. The Property currently contains a Walgreens, a strip shopping center, and a vacant building (formerly a Shop-Rite Supermarket). The Applicant proposes to convert the vacant former supermarket building to a House of Worship/Temple. As more fully described in the Application materials filed with the Board, the Application proposes: (i) structural modifications to the existing building to increase the interior ceiling height; (ii) the "squaring off" of the southwest corner of the existing building which creates 68 square feet of additional interior space; (iii) the construction of a 1,620 square feet portico to the front of the building (facing River Road); (iv) the construction of a playground; and (v) additional various site/building improvements and amenities, such as landscaping and lighting. Also, the Application proposes a facelift to the facade of the strip shopping center.
The additional details of the proposed House of Worship use are contained in the Application materials filed with the Board and available for inspection as detailed below (and will be placed on the record before the Board at the April 6, 2026 Public Hearing detailed below), but generally, formal religious worship occurs once per week on Saturday, generally between 2 PM and 8 PM., with arrivals to the Temple occurring in a staggered manner depending upon circumstances applicable individually to the specific devotees and family. A resident priest and family, who are caretakers of the facility, will reside at the Temple to perform the required daily religious rites of the Temple.
In addition to the request for approval of the preliminary and final major site plan, the Applicant also seeks the following bulk (c) variance relief: (1) Maximum Building Coverage – 30.95% proposed; 30% permitted; (2) Maximum Impervious Coverage – 82.59% proposed; 81.01% existing; 60% permitted; (3) Maximum Building Height – 38.5 feet proposed; 35 feet permitted; and (4) and/or any other relief which may be deemed required by the Board in connection with the following existing non-conforming conditions which are not changed by the Application: (i) Front Yard Setback – maximum 10 feet for corner lot (17.2 feet River Road; 39.9 feet Richard Street existing); (ii) Rear Yard Setback - corner lot 57.75 feet required; 25.4 feet existing); and (iii) location of off-street parking as required by Ordinance §125-25 C(6)(c)&(d)(parking beneath the building is not permitted/101 parking spaces are existing beneath the building).
In addition to the above described Application and requests for relief, the Applicant will also seek the Board's approval for any and all variances, exceptions, waivers, and other incidental relief that may be required or deemed necessary by the Board and/or its professionals after or during its review of this Application, together with any further relief that may be deemed necessary by the Applicant and/or Board during the hearing process, including that which may be generated by way of revised plans and submission of same, including, without limitation, a parking variance. Measurements, percentages and other calculations provided in this notice are in accordance with the documents filed with the Application. Please note that to the extent plan and/or Application revisions are made during the hearing process, these measurements, percentages, and other calculations will likely change as will the associated relief required per the applicable Ordinance. The Applicant will seek approval for any such modifications and/or revisions.
The Board has scheduled a public hearing on this application for Monday, April 6, 2026 at 7:30 P.M. at the Borough of Fair Lawn Borough Hall, 8-01 Fair Lawn Avenue, Fair Lawn, New Jersey 07410 at which time you may appear if you wish to be heard with respect to this Application. A copy of the plan and all application documents and plans for which approval/relief is sought as summarized above are on file with the Administrative Officer/Board Secretary located at Fair Lawn Borough Hall, 8-01 Fair Lawn Avenue, Room #112, Fair Lawn, NJ 07410 and are available for inspection during normal business hours.
