CITY OF ANTHONY, NEW MEXICO NOTICE OF INTENT TO ADOPT ORDINANCE AMENDING INDUSTRIAL REVENUE BOND ORDINANCE

CITY OF ANTHONY, NEW MEXICO NOTICE OF INTENT TO ADOPT ORDINANCE AMENDING INDUSTRIAL REVENUE BOND ORDINANCE Notice is hereby given of the title and general subject matter contained in an ordinance which the Board of Trustees of the City of Anthony, New Mexico (the "City"), the governing body of the City, intends to adopt at a meeting on December 3, 2025 at the hour of 6:00 p.m. at the Municipal Building, 820 HWY 478 Anthony Drive, Anthony, New Mexico relating to an amendment to an ordinance adopted in connection with issuance and sale by the City of Anthony, New Mexico of its industrial revenue bonds. The title of each proposed Ordinance is: AN ORDINANCE AUTHORIZING THE EXECUTION AND DELIVERY OF AN AMENDMENT AND RESTATEMENT OF THE $40,000,000 CITY OF ANTHONY, NEW MEXICO TAXABLE INDUSTRIAL REVENUE BOND (VALLEY COLD STORAGE & TRANSPORTATION, LLC PROJECT) SERIES 2016 TO INCREASE THE MAXIMUM PRINCIPAL AMOUNT THEREOF TO $80,000,000, AND AUTHORIZING THE EXECUTION AND DELIVERY OF AMENDMENTS TO THE LEASE AND THE INDENTURE TO REFLECT THE INCREASE IN THE MAXIMUM PRINCIPAL AMOUNT OF THE BONDS AND OTHER MATTERS RELATING THERETO. As proposed in the Ordinance: (1) the City of Anthony, New Mexico (the "City") $40,000,000 Taxable Industrial Revenue Bonds (Valley Cold Storage & Transportation, LLC LLC), Series 2016 (the "Bond") would be amended and restated to increase the maximum principal amount thereof to $80,000,000 and (ii) the Lease Agreement between the County and Valley Cold Storage & Transportation, LLC (the "Company") dated as of December 1, 2016, and the Indenture among the County, the Company, the Bond Purchaser and BOKF, N.A., each entered into in connection with the issuance of the Bonds, would be amended to reflect the increase in the maximum principal amount of Bonds to $80,000,000. A copy of the Ordinance in draft form is on file in the office of the City Clerk at the Municipal Building, 820 HWY 478 Anthony Drive, Anthony, New Mexico and will be available for inspection during normal business hours.
