NOTICE OF DECISION

PLEASE TAKE NOTICE that the Zoning Board of Adjustment of the City of Englewood, New Jersey, at its regular public meeting held on April 16, 2026, and memorialized by Resolution adopted on June 2, 2026, APPROVED a one (1) year extension of variance relief pursuant to N.J.S.A. 40:55D-52 upon application of Eric Tuy and Monica Canlas Tuy, owners of the property located at 557 Dow Place, City of Englewood, designated on the Tax Map of the City of Englewood as Block 3012, Lot 1 (the "Property").
The original variance approval, memorialized by Resolution on March 24, 2025, granted dimensional variance relief in connection with the construction of a one-story rear addition to the existing single-family residence on the Property, located in the R-E One Family Residence District, including relief from the following requirements of the Englewood Zoning Ordinance:
§ 250-59I(1): Minimum rear yard setback (30 ft. required; 9.8 ft. proposed)
§ 250-59I(M)(1): Maximum building coverage (27% required; 39.9% proposed)
§ 250-59I(M)(2): Maximum impervious coverage (67% required; 67.4% proposed)
The extension was granted for good cause shown pursuant to N.J.S.A. 40:55D-52, based on findings that the Applicant was unable to proceed with construction due to litigation with a contractor and the prior property seller, which concluded in February 2026, as well as exceptionally poor winter weather conditions.
The vote was 7 Ayes, 0 Nays, 2 Absent, 0 Abstain.
A copy of the Resolution is on file and available for public inspection at the Office of the City Clerk and the Zoning Board of Adjustment, City Hall, Englewood, New Jersey, during normal business hours.
