ORDINANCE NO. 1132
AN ORDINANCE AMENDING THE JOHNSTON REVISED ORDINANCES OF 2007 BY AMENDING THE OFFICIAL ZONING MAP TO REZONE 10.03 Acres From AR, Agricultural Reserve District and R-1 (100), Large Lot Residential to R-1 (75), Medium Lot Residential District With A-K, Animal Keeping Overlay
WHEREAS, the Planning and Zoning Commission reviewed this item at their regular meeting on January 27th, 2025 and recommends approval of the proposed rezoning; and,
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JOHNSTON, IOWA THAT:
SECTION 1. PURPOSE. The purpose of this ordinance is to change the Official Zoning Map of the City of Johnston, Iowa, under the provisions of Chapters 165 to 190 (Zoning Ordinance), Chapter 166 (General Provisions), Section 167.02 (District Boundaries and Official Zoning Map) of the Johnston Municipal Code.
SECTION 2. OFFICIAL ZONING MAP AMENDED From AR, Agricultural Reserve District and R-1 (100), Large Lot Residential to R-1 (75), Medium Lot Residential District With A-K, Animal Keeping Overlay. The following legally described property is hereby rezoned from AR, Agricultural Reserve District and R-1 (100), Large Lot Residential to R-1 (75), Medium Lot Residential District With A-K, Animal Keeping Overlay:
LOT 6 LYING ADJACENT TO THE EAST LINE OF LOTS 1, 2, AND 3 OF WOODED ACRES PLAT 1, AN OFFICIAL PLAT IN THE CITY OF JOHNSTON, POLK COUNTY, IOWA.
AND
LOT 6 EXCEPT LYING ADJACENT TO THE EAST LINE OF LOTS 1, 2, AND 3 OF WOODED ACRES PLAT 1, AN OFFICIAL PLAT IN THE CITY OF JOHNSTON, POLK COUNTY, IOWA.
SECTION 3. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION 4. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 5. WHEN EFFECTIVE. This ordinance shall be in full effect from and after its final passage, approval, and publication as provided by law.
