CITY OF ORMOND BEACH PUBLIC HEARING NOTICE IS HEREBY GIVEN that the Board of Adjustments and Appeals of the City of Ormond Beach, Florida, pursuant to the City's Land Development Code, will hold a Public Hearing on Wednesday, December 3, 2025 at 6:00 PM in the City Commission Chambers at the Ormond Beach City Hall, 22 South Beach Street, Ormond Beach, Florida, for the purpose of hearing all parties in interest and to consider and act upon the application of Betty Pepper, property owner of 470 John Anderson Drive. The applicant is seeking an after-the-fact variance to legitimize, through the permitting process, a covered dock structure reconstructed at the end of an existing dock walkway. The property is in the R-1 (Residential Estate) zoning district. Section 2-50(e)(4)(a) of the Land Development Code requires that if the length of the shoreline is sixty-five feet (65') or more, a minimum twenty-five-foot (25')-setback from the riparian lines of adjacent owners is required for all structures. The subject property has a shoreline length of 104.5'. The applicant is seeking to permit the partially constructed dock structure, located at the end of the existing 140.3' walkway, with a side setback of 15.6, requiring a variance of 9.4' to the required 25' setback. The survey provided shows a 16.6' side setback to the existing floor of the structure, the applicant has requested a 15.6' setback to ensure the 12" roof overhang is included in the final setback. The property is located at 470 John Anderson Drive, Volusia County Parcel Number: 421014050220 and is legally described as N 104.38 FT OF S 154.38 FT W OF JA HWY OF LOT 5 ASSRS TRITON PER OR 3973 PG 2440.
