CITY OF ORMOND BEACH
PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Board of Adjustments and Appeals of the City of Ormond Beach, Florida, pursuant to the City's Land Development Code, will hold a Public Hearing on Wednesday, August 5, 2026 at 6:00 PM in the City Commission Chambers at the Ormond Beach City Hall, 22 South Beach Street, Ormond Beach, Florida, for the purpose of hearing all parties in interest and to consider and act upon the application of Adelson Ramos and Melba Ramirez, property owners of 716 S. Beach Street. The property is located in the R-2 (Single-Family Low Density) zoning district. The applicant is proposing to construct a second-story addition to the existing non-conforming single-family residence. As part of the improvements, the applicant is requesting four variances as follows:
Variance A: North Side Yard. Section 2-13.B.9.c. of the Land Development Code (LDC) requires a minimum 8'-side yard setback. The applicant is requesting a side yard setback on the north side of the property of 4.8', requiring a variance of 3.2', to construct a second-story addition and expand the single-car garage.
Variance B: South Side Yard. Section 2-13.B.9.c. of the Land Development Code (LDC) requires a minimum 12'-side yard setback. The applicant is requesting a side yard setback on the south side of 6.8', requiring a variance of 5.2', to construct a second-story addition.
Variance C: Combined Side Yards. Section 2-13.B.9.c. of the Land Development Code (LDC) requires a combined side yard setback of 20'. Based on the existing non-conforming side yard setbacks, the applicant is requesting a combined side yard setback total of 11.6', requiring a variance of 8.4' to the required 20'-combined yard setback to construct a second-story addition.
Variance D: Front Yard Second-Story-Covered Balcony. The Rio Vista Section A subdivision plat calls out a 75'-building setback line abutting South Beach Street (formerly Dixie Highway). The single-family residence has an existing non-conforming front yard setback on the south side of the property of 73.2'. The applicant is requesting a front yard setback on the south side of the structure of 70.2', requiring a variance of 4.8' to the required 75'-front yard setback, for a second-story hard-roof-covered balcony on the front of the home.
The property is located at 716 S. Beach Street, Volusia County Parcel Number: 4242-20-35-0200 and is legally described as LOT 20 BLK 35 RIO VISTA MB 6 PG 25 PER OR 5199 PG 1272 PER OR 5383 PG 4740 PER OR 6978 PG 0839 PER OR 6978 PG 0840 PER OR 7603 PGS 4734-4735 PER OR 8058 PG 0750.
ALL PERSONS IN INTEREST and persons for or against the requested variance shall have the opportunity to be heard at this Public Hearing. Copies of the request are available for inspection by the public in the Planning Department, Ormond Beach City Hall, 22 South Beach Street, Room 104, Ormond Beach, Florida.
