CITY OF WAUKEE
NOTICE OF PUBLIC HEARING CONCERNING THE VACATION OF A PUBLIC STORM SEWER EASEMENT AND A PUBLIC UTILITY EASEMENT PURSUANT TO IOWA CODE SECTION 354.23
The City Council of the City of Waukee, Iowa will consider a proposal to vacate a portion of the Public Storm Sewer Easement as recorded in Document # 2025-0151 and a portion of a Public Utility Easement as recorded in Book 2012, Page 23864, both legally described as:
PUBLIC STORM SEWER EASEMENT:
A PART OF LOT 1, KETTLESTONE CENTRAL SOUTH PLAT 3, AN OFFICIAL PLAT IN THE CITY OF WAUKEE, DALLAS COUNTY, IOWA AND MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHWEST CORNER OF SAID LOT 1; THENCE NORTH 83°47'58" EAST ALONG THE NORTHERLY LINE OF SAID LOT 1, A DISTANCE OF 8.40 FEET; THENCE SOUTH 06°12'02" EAST, 5.91 FEET TO THE POINT OF BEGINNING; THENCE SOUTH 72°01'49" EAST, 21.92 FEET; THENCE SOUTH 06°12'02" EAST, 25.12 FEET; THENCE SOUTH 83°47'58" WEST, 20.00 FEET; THENCE NORTH 06°12'02" WEST, 34.09 FEET TO THE POINT OF BEGINNING AND CONTAINING 0.01 ACRES (592 SQUARE FEET).
PUBLIC UTILITY EASEMENT:
A PART OF LOT 1, KETTLESTONE CENTRAL SOUTH PLAT 3, AN OFFICIAL PLAT IN THE CITY OF WAUKEE, DALLAS COUNTY, IOWA AND MORE PARTICULARLY DESCRIBED AS A 40.00 FOOT WIDE EASEMENT BEING 20.00 FEET ON EACH SIDE OF THE FOLLOWING CENTERLINE:
COMMENCING AT THE NORTHWEST CORNER OF SAID LOT 1; THENCE NORTH 42°08'23" WEST ALONG THE WESTERLY LINE OF SAID LOT 1, A DISTANCE OF 63.71 FEET; THENCE SOUTH 47°51'37" EAST, 15.00 FEET TO THE POINT OF BEGINNING; THENCE CONTINUNING SOUTH 47°51'37" EAST, 20.00 FEET TO THE POINT OF TERMINUS. SAID EASEMENT CONTAINS 0.02 ACRES (800 SQUARE FEET).
A public hearing has been set to consider the vacation of the City's interest in the aforementioned easements for the 15th day of September, 2025, at 5:30 p.m., Waukee City Hall, 230 W. Hickman Road, Waukee, IA 50263.
The portions of the easements being vacated are depicted on the above referenced plat on file with the City Clerk of the City of Waukee, Iowa. If the Public Storm Sewer Easement and Public Utility Easement are deemed by the City Council to be of no benefit to the public, the Council may vacate the same. The vacation of the easements would extinguish the easements and quiet title to the area to the owners of the property on which the easements are currently situated.
The public is invited to attend and participate in the public hearing to provide comment for consideration by the City Council concerning the vacation of the Public Sanitary Sewer Easement described above. In accordance with Iowa Code Sections 21.4(1)(b) and 21.8, this meeting of the Waukee City Council will be conducted with two different options for public participation: 1) Members of the public wishing to attend in person may do so in the Council Chambers at Waukee City Hall. 2) Members of the public wishing to participate electronically may do so via Zoom at the following link or phone numbers:
