CITY OF WAUKEE NOTICE OF PUBLIC HEARING CONCERNING THE VACATION OF PORTIONS OF SANITARY SEWER EASEMENT PURSUANT TO IOWA CODE SECTION 354.23 The City Council of the City of Waukee, Iowa will consider a proposal to vacate portions of the existing Sanitary Sewer Easement as recorded in Book 2023, Page 2522, legally described as: A PART OF LOT 1, PARKSIDE PROPER PLAT 1, AN OFFICIAL PLAT IN THE CITY OF WAUKEE, DALLAS COUNTY, IOWA AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE NORTHEAST CORNER OF SAID LOT 1; THENCE SOUTH 00°14'00" WEST ALONG THE EAST LINE OF SAID LOT 1, A DISTANCE OF 22.00 FEET TO THE SOUTHERLY LINE OF AN EXISTING PUBLIC SANITARY SEWER EASEMENT; THENCE NORTH 89°46'00" WEST ALONG SAID SOUTHERLY LINE, 189.50 FEET TO THE POINT OF BEGINNING; THENCE SOUTH 00°14'00" WEST ALONG SAID SOUTHERLY LINE, 148.48 FEET; THENCE NORTH 78°26'54" WEST ALONG SAID SOUTHERLY LINE, 2.04 FEET; THENCE NORTH 00°14'00" EAST, 148.08 FEET; THENCE SOUTH 89°46'00" EAST, 2.00 FEET TO THE POINT OF BEGINNING AND CONTAINING 0.01 ACRES (297 SQUARE FEET). A public hearing has been set to consider the vacation of the City's interest in the aforementioned portions of easement for the 18th day of May, 2026, at 5:30 p.m., Waukee City Hall, 230 W. Hickman Road, Waukee, IA 50263. The portions of easement being vacated are depicted on the above referenced plat on file with the City Clerk of the City of Waukee, Iowa. If the portions of Sanitary Sewer Easement are deemed by the City Council to be of no benefit to the public, the Council may vacate the same. The vacation of the portions of easement would extinguish the portions of easement and quiet title to the area to the owners of the property on which the portions of easement are currently situated. The public is invited to attend and participate in the public hearing to provide comment for consideration by the City Council concerning the vacation of portions of the Sanitary Sewer Easement described above.
