COMMISSIONER'S NOTICE OF SALE
WHEREAS, on September 30, 2019, Tachana Michelle Hurst a/k/a Tachana M. Hurst executed a Deed of Trust (hereinafter the "Deed of Trust") to Cadence Bank f/k/a BancorpSouth Bank as recorded as Instrument #1593773 in Book 7239 Page 6546 in the land records of the Chancery Clerk of Hinds County, Mississippi; and
WHEREAS, by that certain Agreed Judgment and Default Judgment Authorizing Judicial Foreclosure and Final Judgment on the Pleadings ("Judgment") dated November 6, 2025, in the matter of Cadence Bank f/k/a BancorpSouth Bank v. Tachana Michelle Hurst a/k/a Tachana M. Hurst, et al., Civil Action No. 2024-1333, the Chancery Court appointed Underwood Law Firm, PLLC as the Court's Commissioner to conduct a judicial foreclosure sale of the property encumbered by the Deed of Trust, as amended and corrected under the Judgment, in accordance with the terms of the Judgment and the Deed of Trust, in order to raise the sums due to Cadence Bank together with Commissioner's fees, attorney's fees, and expenses of sale; and
WHEREAS, Underwood Law Firm, LLC was duly appointed and authorized by Cadence Bank to act for and on its behalf as Commissioner of the foreclosure sale; and
WHEREAS, default having been made in the terms and conditions of the Deed of Trust and the entire debt secured thereby having been declared due and payable in accordance with the terms of the Deed of Trust, and the legal holder of the indebtedness secured thereby, Cadence Bank, having requested the undersigned Commissioner to execute the trust and sell the land and property in accordance with the terms of the Deed of Trust for the purpose of raising the sums due thereunder together with Commissioner's fees, attorney's fees, and expenses of sale.
NOW, THEREFORE, we, Underwood Law Firm, PLLC, Commissioner, will on December 5, 2025, offer for sale at public outcry to the highest bidder for cash within legal hours (between the hours of 11 a.m. and 4 p.m. prevailing Central time) at the North front door of the First Judicial District of Hinds County, Mississippi, courthouse located at 407 East Pascagoula Street, Jackson, MS 39201, the following described land and property situated in Hinds County, Mississippi:
A certain parcel of land being Lot 32, North Brighton, Part 3, situated in the South half of
Section 4, Township 6 North , Range 2 East, City of Jackson, a subdivision according to the map or plat thereof which is on file and of record in the office of the Chancery Clerk of Hinds County at Jackson, Mississippi in Plat Book 32 at Page 48, reference to which is hereby made in aid of and as a part of this description. Less and except a 537.16 square foot parcel of land being more particularly described as follows: Beginning at the Northeast corner of the aforesaid Lot 32, North Brighton, Part 3, and run thence South 25 degrees 06 minutes 05 seconds East 118.88 feet along the east line of said Lot 32, North Brighton, Part 3, to the Southeast corner of said Lot 32, said corner also being the North right of way line of North Brighton Drive; leaving said North right of way of line; run thence North 29 degrees 17 minutes 53 seconds West 123.49 feet to a point on the North line of said Lot 32; run thence South 89 degrees 45 minutes 00 seconds East 10.00 feet along said North line to the Point of Beginning.
PLEASE TAKE NOTICE that the foreclosure sale is subject to the conditions set forth in the Judgment that authorized this judicial foreclosure and that a hearing to consider confirmation of the sale is scheduled for December 18, 2025, at 10:00 a.m., prevailing Central time, before the Honorable Tametrice Hodges-Linzey in the Hinds County Chancery Courthouse located in Jackson, Mississippi.
UNDERWOOD LAW FIRM PLLC will convey only such title as is vested in it as Commissioner.
