COMMISSIONER'S NOTICE OF SALE
WHEREAS, on or about September 15, 2014, J. Caleb Cook a/k/a Jared Caleb Cook and Sarah P. Cook a/k/a Sarah Pope Cook executed a Deed of Trust (hereinafter the "Deed of Trust") to The Huntington National Bank as successor by merger to Cadence Bank, formerly BancorpSouth Bank as recorded as Instrument #740506 in Book 3127 Page 826 in the land records of the Chancery Clerk of Madison County, Mississippi; and
WHEREAS, the Deed of Trust is held by The Huntington National Bank pursuant to an Amendment to the Charter of Incorporation of BancorpSouth Bank; and
WHEREAS, by that certain Agreed Judgment and Final Judgment on the Pleadings Authorizing Judicial Foreclosure ("Judgment") dated April 13, 2026, in the matter of Cadence Bank f/k/a BancorpSouth Bank v. J. Caleb Cook, et al., Civil Action No. 25-01388, the Chancery Court appointed Underwood Law Firm, PLLC as Commissioner to conduct a judicial foreclosure sale of the property encumbered by the Deed of Trust in accordance with the terms of the Judgment and the Deed of Trust, in order to raise the sums due to The Huntington National Bank together with Commissioner's fees, attorney's fees, and expenses of sale; and
WHEREAS, Underwood Law Firm, PLLC was duly appointed and authorized by The Huntington National Bank to act for and on its behalf as Commissioner of the foreclosure sale; and
WHEREAS, default having been made in the terms and conditions of the Deed of Trust and the entire debt secured thereby having been declared due and payable in accordance with the terms of the Deed of Trust, and the legal holder of the indebtedness secured thereby, The Huntington National Bank, having requested the undersigned Commissioner to execute the trust and sell the land and property in accordance with the terms of the Deed of Trust for the purpose of raising the sums due thereunder together with Commissioner's fees, attorney's fees, and expenses of sale.
NOW, THEREFORE, we, Underwood Law Firm, PLLC, Commissioner, will on June 9, 2026, offer for sale at public outcry to the highest bidder for cash within legal hours (between the hours of 11 a.m. and 4 p.m. prevailing Central time) at the east front door of the Madison County, Mississippi courthouse located at 229 N. Union Street, Canton, MS 39046, the following described land and property situated in Madison County, Mississippi:
Lot 292, Timber Ridge of Wellington, Part Three-A, a subdivision according to the map or plat thereof on file and of record in the office of the Chancery Clerk of Madison County at Canton, Mississippi in Plat Cabinet E at Slide 177B, reference to which map or plat is hereby made in aid of and as a part of this description.
PLEASE TAKE NOTICE that the foreclosure sale is subject to the conditions set forth in the Deed of Trust and Judgment that authorized this judicial foreclosure and that a hearing to consider confirmation of the sale is scheduled for June 18, 2026, at 8:45 a.m., prevailing Central time, before the Honorable James C. Walker in the Madison County Chancery Courthouse located in Canton, Mississippi.
UNDERWOOD LAW FIRM PLLC will convey only such title as is vested in it as Commissioner.
