City of Petoskey Ordinance 814 AN ORDINANCE AMENDING CHAPTER 21 TRAFFIC AND MOTOR VEHICLES OF THE CITY CODE REGULATING BICYCLES The City of Petoskey Ordains: Section 1. Amendment of Section 21-80. Section 21-80 of the City of Petoskey Code of Ordinances is amended to read in its entirety as follows: Sec. 21-80 – Violation; penalty Persons who violate a provision of this Code or fail to comply with any of the requirements thereof, shall be guilty of a municipal civil infraction and subject to civil fines according to the schedule of civil fines established by resolution of the city council, and shall be subject to any other relief that may be imposed by a court for such conduct, which shall also be considered a nuisance per se. Each act of violation and each day upon which such violation occurs shall constitute a separate violation. Section 2. Amendment of Section 21-82. Section 21-82 of the City of Petoskey Code of Ordinances is amended to read in its entirety as follows: It shall be unlawful for every person traveling on any trail or walkway, designated a "non-motorized trail," to use a bicycle, or any other vehicle, at a rate of speed exceeding 20 miles per hour. Nothing in this Section shall be construed to permit the use of bicycles or other vehicles as prohibited by Section 21-84. Section 3. Amendment of Section 21-83. Section 21-83 of the City of Petoskey Code of Ordinances is amended to read in its entirety as follows: It shall be unlawful for any individual to use any type of vehicle, unless propelled solely by human power or propelled by assisted pedal power (pedelec electric bicycle), on a trail or walkway designated as a "non-motorized trail." Mopeds, electric bicycles and similar assistance mobility devices are expressly prohibited. Nothing in this Section shall be construed to permit the use of bicycles or other vehicles as prohibited by Section 21-84. Section 4. Addition of a New Section 21-84. The City of Petoskey Code of Ordinances is amended by the addition of a new Section 21-84, which reads in its entirety as follows: Sec. 21-84 – Prohibited Use. Use of bicycles shall be prohibited on sidewalks or pedestrian walkways in the central business district and the park reserve district between Bay Street and East Mitchell Street, including on Park Avenue between Bay Street and Howard Street of the City of Petoskey, as shown on the zoning map of the City. This Article shall not be construed to prohibit the use of any wheelchair and/or any other similar vehicle, whether operated manually, by electric motor or any other method by a person with a certified disability requiring mobility assistance related to health or physical disabilities. This Ordinance shall take effect fourteen (14) days following its enactment. Adopted, enacted, and ordained by the City of Petoskey City Council this 6th day of July, 2026.
