RESOLUTION SETTING PUBLIC HEARING
ON THE PROPOSED ASSESSMENT ROLL 1

WHEREAS, the following improvements, as listed and adopted below, have been made under Minnesota Statutes Annotated, Chapter 429, as amended:

WHEREAS, the City Engineer has certified to the proper completion of:
I.CONTRACT 2025-01 – PAN PARK PLACE NEIGHBORHOOD IMPROVEMENTS – PHASE 4
SURFACE IMPROVEMENTS
A.Reconstruct curb and gutter and bituminous street surface at the following locations: 7th Street North from 25th to 29th Avenue North.9th Street North from 27th to 29th Avenue North.26th and 27th Avenue North from 7th to 8th Street North.28th and 29th Avenue North from 7th to 9th Street North.
B.Resurface alleys at the following locations:

II.CONTRACT 2025-03 – LINCOLN AVENUE FROM NORTH CITY LIMITS TO 7TH STREET SE IMPROVEMENTS

Lincoln Avenue from 7th Street SE to East St. Germain Street.
B.Edge mill and overlay improvements at the following location:
Lincoln Avenue from East St. Germain Street to the North City Limits.
SIDEWALK IMPROVEMENTS
C.Reconstruct and/or install new concrete sidewalk at the following locations:
Lincoln Avenue from 7th Street SE to 4th Street SE (east side).
Lincoln Avenue from 4th Street SE to East St. Germain Street (both sides).
UTILITY IMPROVEMENTS
E. Repair Sauk Rapids forcemain at the following location:
1.Lincoln Avenue approximately 400 feet north of 4½ Street NE.
F.Replace water main and water service lines at the following location:
Lincoln Avenue from 7th Street SE to 1st Street SE.
G.Replace storm drain at the following location:
Lincoln Avenue from 7th Street SE to East St. Germain Street.
III. CONTRACT 2025-02 – 2025 BITUMINOUS STREET RESURFACING IMPROVEMENTS
SURFACE IMPROVEMENTS
A. 2" edge mill and overlay improvements on approximately 8.3 miles of street segments within the City of St. Cloud.
IV. CONTRACT 2025-50 – MISCELLANEOUS ASSESSMENT AGREEMENTS
Private Sanitary Sewer Work at Lot 10, Block 1, Barritt's Addition.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ST. CLOUD, MINNESOTA:
1.That a public hearing shall be held on Monday, the 9th day of March, 2026, at 6:00 p.m. in the City Council Chambers, City Hall, 1201 – 7th Street South, to pass on such proposed assessments and at such time and place all persons owning property affected by said improvements will be given an opportunity to be heard with reference to such assessments.
The City Clerk is hereby directed to cause notice of the hearing on the proposed assessments to be published at least once in the official newspaper at least two (2) weeks prior to the hearing.
3.The City Clerk shall also cause a notice to be mailed to the recorded owner of each parcel of property that is proposed to be assessed, stating the amount proposed to be assessed against each parcel of property.
4.The amount proposed to be assessed is:
Final Project Cost - $12,899,142
Total Assessed - $3,636,184
Adopted this 9 day of February, 2026.
NOTES:
1.The proposed assessment roll is on file and available for inspection at the Office of the City Engineer.
2.At the time of the public hearing, anyone wishing to speak in favor of, in opposition to, or having questions concerning the proposed assessment, will be heard by the Council. Both written and oral statements will be considered. (Note: You are not required to attend this meeting if you are in agreement with the proposed assessment.)
3.An Owner may appeal an assessment to District Court pursuant to Minnesota Statutes Section 429.081 by serving notice of the appeal upon the Mayor or Clerk of the City within 30 days after the adoption of the assessment and filing such notice with the District Court within ten days after service upon the Mayor or Clerk. (No appeal may be taken as to the amount of the assessment unless a signed, written objection is filed with the City Clerk prior to the hearing or presented to the presiding officer at the hearing.)
4. A homesteaded property whose owner is 65 years of age or older, or retired by virtue of permanent and total disability, or owned by a person who is a member of the Minnesota National Guard or other military reserves who is ordered into active military service may be eligible for a deferment of special assessments. Information is available from the Special Assessments Clerk.
