AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WOLFFORTH, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 6, HEALTH AND SANITATION, ARTICLE 6.02 GARBAGE REGULATIONS BY ADDING DIVISION 3 BULKY WASTE FACILITY; REGULATING THE USE OF THE BULKY WASTE FACILITY; PROVIDING A PENALTY CLAUSE; PROVIDING A REPEAL CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
§ 6.02.57 Enforcement and Penalties
(a) Monitoring. Security cameras shall record site activity at the Facility 24/7. Signage shall inform users of video surveillance and enforcement.
(b) Enforcement. This Division shall be enforced by the public works director of the City, their designee, or any law enforcement officer of the City. Each shall have the authority to issue notice of violations for any violation of this Division and any other power or duty stated within the terms of this Chapter. If the person being cited is not present, the public works director or designee may send the notice of violation to the alleged offender by registered or certified mail, return receipt requested, by depositing the same in the U.S. mail, postage prepaid. Police officers may issue a citation or cause issuance of a notice of violation as may be appropriate.
(c) Authority to suspend Access Code.
(1) Conditions for suspension of Access Code. The City shall have the right to suspend an Access Code associated with a Household when it reasonably appears any of the following have occurred:
a. Disposal of Prohibited Materials by a person using the Access Code;
b. Allowing individuals other than members of a Household to use an Access Code;
c. Any conduct that endangers the environment or which threatens to interfere with the operation of the Facility; or
d. Any other violation of this Division.
(2) Not(fication. The City shall give written notice to a Household upon suspension or cancellation of an Access Code.
(3) Duration of Suspension. Any suspension of an Access Code as set forth in this Division will be for a period of six ( 6) months. The subject Household may request a new Access Code upon expiration of the six ( 6) month suspension period.
(d) Penalties. The failure or refusal of any person to comply with any of the provisions of this Division and the violation of any provisions of the Division by any person shall constitute a misdemeanor. Any person, firm, or individual who shall violate any of the provisions of this Division shall be guilty of a misdemeanor, and upon conviction shall be fined in a sum not exceeding Two Thousand Dollars ($2,000.00). Each and every day the violation continues shall constitute a separate and distinct offense.
(e) Appeals. Any resident aggrieved by an Access Code suspension may appeal in writing to the City Manager within ten ( 10) days of notification of the suspension. The City Manager shall render a decision within thirty (30) days. The City Manager's decision is final.
