To: Christine Barron and to all other persons interested.
A petition has been presented to said Court by Joan Magane of Athol in the County of Worcester representing that he hold as tenant in common undivided part or share of certain land lying in Westminster in said County Worcester and briefly as follows: A certain parcel of land with the buildings, structures and improvements thereon, situated on the northwesterly side of Howard Avenue in said Westminster, being lot #108 as shown on a plan entitled "Plan of Lots of Charles L. Smith, Westminster, Mass. Scale 1 inch = 50 feet, April 24, 1953, Stanley G. Kendall, C.E." which plan is recorded with Worcester Northern District Deeds, Plan Book 93, Plan 7, and more particularly bounded and described as follows: Commencing at an iron pipe in the intersection of the northerly line of said Howard Avenue and the westerly line of Elm Street; Thence at an included angle of 83° 09' northwesterly 125 feet by the line of said Elm Street to an iron pipe; Thence at an included angle of 96° 51' southwesterly by land now or formerly of Charles L. Smith, the same being Lot 118 as shown on same plan; Thence southeasterly at an included angle of 83° 09' by the line of Lot # 107 as shown thereon 125 feet to the line of said Howard Avenue; Thence northeasterly at an included angle of 96° 31' by the line of said Howard Avenue 125 feet to the place of beginning. Being the same premises conveyed to Joan C. Magane and Christine A. Barron, as joint tenants, by deed of Sandra Eidinger dated June 10, 2019 and recorded in the Worcester Northern Registry of Deeds Book 9358, Page 118. setting forth that he/she desire that all the aforesaid described part of said land my be sold at private sale not less than five-hundred fifty thousand (550,000.00) dollars, and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided either at private sale or public auction, and be ordered to distribute the net proceeds thereof.
If you desire to object thereto you or your attorney should file a written appearance in said Court at Worcester before ten o'clock in the forenoon on the twentieth day of January the return day of this citation.
