To: Derek L. Gaidanowicz and to all other persons interested. A petition has been presented to said Court by Michelle Frigon of Gardner in the County of Worcester representing that he hold as tenant in common, undivided, part or share of certain land lying in Hubbardston in said County Worcester and briefly as follows: The Land referred to herein below is situated in the County of WORCESTER, State of MA, and is described as follows: 150 New Templeton Road: BEGINNING: at the northwesterly comer thereof at an iron pin in the easterly line of New Templeton Road, at a comer of other land now or formerly of Dymek Custom Builders, Inc., said other land being shown as Lot 5 on said Plan; THENCE:N. 60° 26' 27'E. by said other land of Dymek Custom Builders, Inc., and said Lot 5, four hundred forty-seven and seventy-two hundredths (447.72) feet to a point in line of land now or formerly of Norman A. and Jeanne M. Hebert; THENCE: S. 17° 01' 27'E. by said Hebert land, two hundred fifty and zero hundredths (250,00) feet to a comer of other land now or formerly of Dymek Custom Builders, Inc., being shown as Lot 3 on said Plan; THENCE: S. 66° 53' 13" W. by said Dymek Custom Builders, Inc., land and said Lot 3, four hundred forty-two and twenty eight hundredths ( 442.28) feet to an iron pin in the easterly line of New Templeton Road; THENCE: N. 20° 40' 06 W. sixty-four and forty hundredths (64.40) feet; THENCE: N. 18° 36' 04"W. sixty-six and three hundredths (66.03) feet; THENCE: N. 09° 55' 28'W. seventy and zero hundredths (70.00) feet to an iron pin at a comer of land of the first mentioned Dymek Custom Builders, lnc.,and said Lot 5 and the point of beginning, setting forth that she desires that all of the aforesaid described part of said land may be sold at private sale not less than Four Hundred Fifty Five Thousand ($455,000.00) dollars, and praying that partition be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of al,, or any part of said land which the Court finds cannot be advantageously divided either at private sale or public auction, and be ordered to distribute the net proceeds thereof. If you desire to objection thereto you or your attorney should file a written appearance in said Court at Worcester before ten o'clock in the forenoon on the Eleventh day of November the return day of this citation.
